History Unfolded Project Part 5: Jewish Refugees, Hoosier Rescue

$360. That was the cost in May 1938 to rescue a Jewish child from Nazi controlled Austria. $360 would pay for her relocation to a new home in Palestine, and care for her for two years. All this for $360. $360 to save the life of a child.

In May 1938, the national Youth Aliyah Committee identified 1,000 Jewish Austrian children who could leave the country with valid visas, but only until September 30 when the passes to leave Austria expired. One Indianapolis woman refused to allow this brief window of opportunity to close without trying to save these young Austrians. After all, Sarah Wolf Goodman was herself a Jew born in Austria who must have felt great empathy for those who shared her homeland. She was not alone. While the U.S. government was slow to act, many private citizens worked to aid refugees fleeing Germany and Austria after the Anschluss in 1938. And some of these notable American activists were Hoosiers.

Over the last year, we have been looking at Indiana newspapers to try and determine how much information Hoosiers received through the press about the events leading up the Holocaust. In the last History Unfolded post (Part 4) we also met the tireless and prescient diplomat, James G. McDonald, who tried to warn the world about the impending atrocities. In this post, we will examine the failed Evian Conference, news articles about the deepening refugee crisis, and editorials about how Hoosiers believed the U.S. should respond. We’ll continue to follow McDonald who attended the conference and we’ll meet Sarah Wolf Goodman, another bold and industrious Hoosier who showed her community what could be accomplished without leaving home.

The purpose of this project is twofold: 1. to contribute Indiana newspaper articles to the United States Holocaust Memorial Museum’s History Unfolded database to help the museum determine what the average American knew about the Holocaust; and 2. to analyze these articles and share with our readers our findings on what Hoosiers knew and how they responded. Hopefully, a greater understanding of the events surrounding the Holocaust can inform our responses to current world crises. Anyone can contribute articles to History Unfolded. Anschluss

In January 1933, Jewish Germans made up about one percent of the country’s total  population. The greatest number of Jews resided in Berlin. Over the following years, the Nazis banned Jews from civil service, boycotted Jewish businesses, and stripped away their citizenship rights with the declaration of the Nuremberg Laws. By 1938, the Nazis made life so difficult for German Jews that about 150,000 left the country, according to the USHMM. This was one-fourth of the entire Jewish population. When Germany annexed neighboring Austria in March 1938, many more Jewish people were forced to flee their homes, resulting in a major refugee crisis.

Since the end of World War I, most Austrians supported a union with Germany. However, this consolidation of power was forbidden by the Versailles Treaty. By the mid-1930s, Austria, suffering under a poor economy, saw Hitler as the solution. A bombardment of Nazi propaganda solidified public opinion. Thus, on March 12, 1938, when Nazi troops entered Austria, they were greeted by cheering crowds.

This German-Austrian union, called Anschluss, brought another 185,000 Jews under Nazi rule – all of whom now faced persecution. According to the editors of Refugees and Rescue:*

Austrian anti-Semites, members of the Nazi Party, and police and SS officials immediately attacked, arrested, and humiliated Jews and political opponents in Austria. Confiscation of Jewish property and public scenes such as forcing Jews to scrub sidewalks were everyday occurrences. Hundreds of Austrian Jews committed suicide, and tens of thousands sought to leave as quickly as possible.

The German-Austrian Refugee Crises

These tens of thousands of Austrian Jews joined those from Germany who felt they had no choice other than to leave their homes. However, many who tried to flee were unable to find a country to accept them. According to the USHMM, “a substantial percentage tried to go to the United States.” However, the Immigration Act of 1924, passed during a period of xenophobia and Klan influence, sharply restricted immigration to the United States. Jews were among the ethnic groups deemed undesirable by the legislation and only a very small number were issued immigration visas in the years following the quota enactment. This did not change in 1938. Even in the face of the mounting refugee crises, the United States government largely turned its back on the Jews of Europe.

Widespread American prejudice and anti-Semitism that extending into federal government service definitely contributed to the lack of action, but there were other issues as well. The Great Depression still affected many Americans who feared further competition for jobs. African Americans faced racism and prejudice in addition to the horrors of lynching. It would be hard for many African Americans to see why they should care about injustices across the Atlantic when they faced injustice at home. For other Americans, it simply seemed like a faraway problem of little practical concern to them. Many people simply had their own immediate struggles and problems to make ends meet. Plus, the United States fought in “the war to end all wars” only twenty years earlier. Many just wanted to stay out of what was viewed as Europe’s problem.

For example, in an editorial for the Indianapolis Recorder, African American writer Fletcher Henderson called the annexation of Austria “interesting . . . headline reading for the American people,” but because Hitler was not threatening America, noted it was “nothing for us to become alarmed about.” He stated succinctly, “While we deplore the rape of any nation, it is none of our affair.” Henderson called for the U.S. government, and especially President Franklin D. Roosevelt, to mind its own business. He stated, “If the administration in Washington would bend all of its efforts to end the depression in the United States, it would not have the time even to read of the happenings in the rest of the world.”

James G. McDonald: Stirring the American Conscience

However, there were Americans of conscience who worked relentlessly to find ways to save the Jews of Austria and Germany, some of them Hoosiers. Starting as early as 1933, former Indiana University professor James G. McDonald shared his fears with world leaders that Hitler would eventually order the execution of all the Jewish people under Nazi rule. (Read more about McDonald in the previous post: Part 4). By the time of the Anschluss, McDonald worked tirelessly and traveled widely to spread this warning and raise awareness for the plight of fleeing Jewish refugees. His diary and letters* tell of the frustrating, often bureaucratic, work he undertook in an attempt to convince government, religious, and philanthropic organizations to work together and to connect those who had authority to act with those who had the means to act.

In March 1938, McDonald spoke to a group of potential Jewish donors in New City about the urgent need to give money to save the Jews of Europe who faced annihilation. According to a summary of his speech, McDonald stated:

The war that the Nazis are waging is not a war against the Jews of Germany, but against all Jews, whose influence must be obliterated and who themselves should either be exterminated or driven out of all civilized lands . . . If you think that because you live in the United States you are immune, you are very foolish. Nothing counts these days except money with which to carry on your work of relief, of emigration, and of service to your fellow Jews. Mass meetings, parades, demonstrations, resolutions, getting nice letters from friendly Christians, are all very well, but they don’t actually save a single Jewish life, feed a starving Jewish boy or girl, train a single youth, pay for his emigration, or enable him to start life anew anywhere else.

All over the country and to all kinds of audiences, McDonald reiterated his earlier statements that the refugee crisis was not a Jewish problem but a human one. McDonald called the Nazi persecution of Jews an “attack upon the principles of civilized society” and expressed his disappointment that all Americans were not rising to meet the crises. In accepting the Professor Albert Einstein Medal for Humanitarian Services, he stated:

Until Protestants and Catholics as well as Jews understand, come to see that the things they hold dear, even as the things Jews hold dear, are threatened – not until then will there be an adequate response to enable refugees from Central Europe to be cared for.

McDonald closed his speech by refuting other political leaders’ claims that these refugees who had been stripped of their assets would be a liability and reminded his American audience that they live in a “country of refugees.” In yet another speech, this time to the Jewish Theological Seminary in New York City, he again appealed to his audience’s conscious and pocketbooks:

This problem will require thinking in terms not of a few million dollars, but in terms of tens of millions of dollars. Moreover, the problem is not a Jewish problem. The conscience of America has been stirred.

These Americans, whose consciences has been stirred, placed immense pressure on the U.S. government to act on behalf of those fleeing Nazi persecution. On April 29, 1938, the Jewish Post, published in Indianapolis, reported that “10,000 Americans visited the offices of HIAS (Hebrew Immigration Aid Society) since Anschluss to learn how to bring their relatives to the United States from Austria.” Charitable and religious organizations did not wait for the government to take the lead. For example, the Jewish Welfare Federation advertised a fundraising campaign in the Jewish Post with an $81,640 goal. The ad pleaded for Jewish American aid:

 Against the storm, against the fold of misery, against dire suffering there is only one great barrier . . . the barrier erected by American help. Compared with the need, what we can do is perhaps little, But the little is the only hope of MILLIONS of our fellow Jews. So Give! Be glad you can Give! Give even if it means self-denial! Give so THEY may have a chance to LIVE!

Road to Evian

By May 1938, in response to mounting pressure, the U.S. government attempted to organize a solution in the form of the International Committee for Refugees (later Intergovernmental Committee on Refugees). On May 12, the New York Times reported that the U.S. government suggested the creation of an international committee  “to facilitate the emigration of political refugees from Germany and Austria.” The article reported that the U.S. State Department had consulted with over thirty other countries and scheduled a meeting for July 6 in Evian, France. According to Refugees and Rescue, President Roosevelt “launched [this] initiative without consulting the state department, inviting a range of other governments” to attend the Evian Conference.**

Meanwhile, President Roosevelt also organized his own group of advisers on the refugee crisis. On May 16, this group, the President’s Advisory Committee on Political Refugees, organized and elected James G. McDonald as chairman. According to an account of the founding meeting by Samuel McCrea Cavert of the Federal Council of Churches, President Roosevelt “opened the conference by remarking that the United States has always been deeply sympathetic with political refugees and that the time had come when our country had another historic opportunity to show this sympathy.” However, the president carefully called the emigrants “political refugees” and avoided the term “Jewish refugees.” He seemed more concerned about public opinion than proposed rescue efforts. According to Cavert, in response to proposals that the government loan money to private organizations in position to effect immediate rescue, President Roosevelt stated that “at least for the present it would be unwise to put forward any proposal which would occasion public dispute and controversy, such as a change in the immigration quotas or appropriations or loans from public funds.”  It was clear that raising money would be the key to any successful rescue efforts. And if it were to come in time to help the Jews of Germany and Austria, it would have to come from private organizations, not the government.

As the world awaited the upcoming Evian Conference, the crises mounted. In an article printed in the Indianapolis News in late June, AP Foreign Correspondent, DeWitt Mackenzie described the problems facing the conference. Mackenzie estimated that 450,000 Jews in Austria and Germany were in need of a new country if they were to survive Nazi persecution. However, he speculated that this was perhaps only the beginning of the crisis. Mackenzie wrote:

The anti-Semitic forces in other central and eastern European countries such as Poland, Rumania [sic], Hungary and Lithuania, have been strengthened by events in Germany. Jewish leaders express fear the refugee problem may assume extraordinary proportions if anti-Semitic governments and organizations get the impression that they can solve their Jewish problem by expelling their Jews and trusting the rest of the world to absorb them.

Mackenzie continued by theorizing on how those diplomats about to meet in Evian would handle the crisis. He estimated that they would first attempt to determine the feasibility of convincing the oppressive governments to “diminish anti-Semitic pressure” and allow fleeing emigrants to bring the whole of their property with them. Second, they would try and determine where these refugees would find homes. Like McDonald, Mackenzie made clear that money would be the determining factor in how successful any rescue attempts would be.

On July 2, 1938, just a few days before leaving for the Evian Conference, McDonald served as a sponsor for a Youth Aliyah benefit in New York. “Aliyah” is the Hebrew word for a Jew immigrating to Israel. The Hadassah-sponsored organization aimed to rescue young Jewish refugees and find them new homes in Palestine. The New York Times reported that the proceeds would be used to transport German, Austrian, and Polish refugees to Palestine on 1,100 British visas available until they expired in September. While James G. McDonald worked in New York to raise the $360 per child needed for transportation and two years of care, another Hoosier was hard at work for the same cause back in Indianapolis.

Sarah Wolf Goodman’s “Immediate and Wholehearted Action”

Sarah Goodman was a fixture of Indianapolis society, a prominent Jewish civic leader and supporter of the arts. She was born in Vienna in 1886 and came to St. Louis as a young child. She moved to Indianapolis after her marriage in 1924 to Jack A. Goodman, founder of the Real Silk Hosiery Mills. She was smart, ambitious, and well-connected. She commanded respect and could sway public opinion. In May 1938, she did exactly that.

Goodman devised a plan to address the same issue that faced McDonald: raising enough money for Youth Aliyah to transfer child refugees to Palestine before the September 30 deadline. Goodman shared with the readers of the Jewish Post on May 20 a letter she received from a fourteen-year-old girl who started a “little club of girls, all of about her age” and raised $10 “energetically baking and selling cookies.” The girls sent the money to Goodman asking her to “please accept the enclosed check for $10 and send it on to help save the lives of these poor children” of Austria.

These selfless girls inspired Goodman. She wrote that she believed that young Jewish people in Indiana wanted to help those their age who were suffering Nazi persecution:

In a few weeks many of these eager youngsters will be confirmed or will be graduated from grade school, high school, or college. We, their relatives, will show our love for them by showering them with gifts, some of which will be useful, some of which will never be looked at . . . Children appreciate gifts and the thoughts they express, but more important this year is the fact that they want to share with the Austrian children who have nothing.

Goodman’s plan was simple. She encouraged the families and friends of graduates to make a donation in the name of the graduate, in lieu of a gift, which she would send to the Youth Aliyah fund. The graduate would then receive a “fine” card. She wrote that any amount was acceptable but “only immediate and wholehearted action will suffice,” as the visas expired in a matter of a few months. Goodman stated, “Every one unused represents an opportunity lost forever to snatch a boy or girl from the hell that has been made of a fair country.” The country where she was born.

The Jewish Post supported her endeavors. The editor wrote:

It is to be hoped that Mrs. Goodman’s plan will be seized upon and carried through one hundred per cent. Let the card Mrs. Goodman described become so fashinable [sic] and popular that the tie or book as a gift will become outmoded and in its stead a symbol of Jewish charity on its highest plane – the salvaging of the life of a child will take its place as the finest present possible.

The Indianapolis Star briefly mentioned a lunch fundraiser for Youth Aliyah on its society page, but made no mention of Goodman’s plan. Other Indiana newspapers were silent.

The Evian Conference

Meanwhile, the world waited on the Evian Conference. New York Times reporter Clarence K. Streit wired a report from Evian back to New York on the eve of the parlay. His impression was that the gathered representatives of the world’s democracies were not taking the issue seriously enough and compared the atmosphere to a poker game.

Streit began his report with a reminder to the attendees that the refugees have lost everything “because of their refusal to recant what democrats believe to be true” or because they were born Jewish. He said he repeated this well-known fact in the article because “it seems to be in some danger of being lost at the start.” He took issue with the fact that the negotiations were starting from the perspective of viewing refugees as a burden; their humanity was being lost among the poker-like game of negotiating how that burden would be shared. His impression was spot on.

The conference began July 6, 1938 at a lavish resort on Lake Geneva. Delegates from thirty-two countries attended. President Roosevelt sent Myron C. Taylor as the U.S. representative and James G. McDonald to advise him. Taylor was a wealthy businessman with little previous diplomatic experience. The U.S. agenda for the conference, as determined in a series of June meetings between U.S. State Department representatives and the President’s Advisory Committee chaired by McDonald, represented a weak compromise between their opposing visions. The U.S. would allow political refugees from any country (not just Germany as argued by the State Department) but only within existing quotas (to the chagrin of McDonald and the committee). They would tread carefully on the subject of Palestine to not upset the British delegation, which controlled the region. McDonald was cautiously optimistic that the conference would encourage other countries to accept Jewish refugees. He would be disappointed.

Myron C. Taylor addressed the conference on the opening day. He expressed sympathy for the plight of the refugees but noted that all of the countries present were dealing with a depressed economy and widespread unemployment. He noted that the assembled governments must act “promptly and effectively in a long-range program” to aid the refugees, but also noted that “the problem of political refugees” was “thrust upon them by the policies of some other governments.” He reviewed a world history of voluntary migration and then stated:

Now we have a form of compulsory migration, artificially stimulated by governmental practices in some countries which force upon the world at large great bodies of reluctant migrants who must be absorbed in abnormal circumstances with a disregard of economic conditions at a time of stress.

Taylor stated that the problem was so large, the conference could do nothing more than “put in motion the machinery, and correlate it with existing machinery.” He meant well, but his hands were tied by a U.S. government afraid of public criticism for easing quotas. Again, citing the enormity of the problem, he tried to focus the conference on addressing only German and Austrian refugees (despite the position of McDonald and others on the Advisory Committee). He spent a good amount of his address pondering how the participating governments would document the refugees, and of course, how this immigration would be funded. He offered no solutions other than advising delegates to speak to McDonald about his knowledge of aiding and financing refugees. The other countries followed Taylor’s lead. According to the USHMM:

During the nine-day meeting, delegate after delegate rose to express sympathy for the refugees. But most countries, including the United States and Britain, offered excuses for not letting in more refugees. Only the Dominican Republic agreed to accept additional refugees.

A New York Times article from July 14, succinctly summed up the Evian Conference. The reporter stated that the delegates “did not find a landing place for the thousands of refugees cast upon the world” and that “no doors were thrown open to the involuntary exiles.” The Times writer concluded: “All the delegates professed a sincere desire to do what they could, but none offered to relax the quotas and restrictions that every country has put on immigration.”

Before the conference even ended, McDonald turned his attention to gaining approval and support from the Vatican on addressing the human crisis. He left for Rome immediately after the conference closed. He did not even record his reaction to the Evian Conference in his diary. (Check back for Part 6 which will look at the widely varying Catholic response to the events leading up to the Holocaust and McDonald’s work to influence the Vatican.)

 Goodman and “The Dignity of Man”

With little encouragement from world events, Sarah Goodman continued her campaign in Indiana to raise funds for the rescue of children from Austria. In all, she was able to save two children, with a total of $750 dollars raised, through her plan to collect donations in lieu of graduation gifts. This might not seem like much. However, this was in the midst of the Great Depression. The average income was just over $1,000 a year. Thus, Goodman raised almost a year’s salary for the effort. Additionally, she received no promotion for her idea from any newspapers beside the Jewish Post. Her plan, however, managed to spread. Cincinnati, Nashville, Memphis, Miami, New Orleans, Los Angeles, Seattle, and Washington followed suit.

In September, the Jewish Post enthusiastically reported:

Out from under the blighting shadow of the Nazi swastika over Austria, Jewish boys and girls are sailing away to a life of opportunity and human service in Palestine as the result of a plan translated into action by Indianapolis’ own Mrs. Jack Goodman.

On Thanksgiving Day, appropriately, Goodman shared the thanks of two children with the readers of the Post. She wrote:

On this our Thanksgiving weekend I have been instructed to transmit to all of you the heart-felt thanks of two young people whose lives will be forever yours. They are the youths whose lives were saved by the graduation, confirmation, birthday and other gifts which were made in your names last summer.

 A thousand children were saved by this push for the Youth Aliyah fund. Goodman wrote that “it will never be forgotten that two of this number were saved by the young people of Indiana.” And really, it was the children who led the way, from the young girl who inspired Goodman’s actions to those who sacrificed gifts to help others. One recently confirmed child told the Post that the fund was “a living memorial of the fact that we are lucky to be giving and not getting.”

By September of 1939, around 282,000 Jews had fled from Germany and 117,000 from Austria, according to the USHMM. However, around 202,000 German Jews and 57,000 Austrian Jews were unable to escape, many because of old age. Their numbers fell to 163,000 by October 1941, when then Nazi regime ended Jewish emigration. Again according to the USHMM, “The vast majority of those Jews still in Germany were murdered in Nazi camps and ghettos during the Holocaust.”

Sarah Wolf Goodman did not quit after the drive to help Austrian children ended. She did not quit as the horrific details of the Holocaust trickled and then flooded into newspapers. She spoke around the country, continued to raise money for Hadassah and Youth Aliyah, and helped form new chapters in other cities. She traveled to Palestine to visit the clinics, schools, and scientific farms set up by the Hadassah, of which she was vice-president by the 1940s. Despite her gender, the Jewish Post named her Indiana’s Jewish Man of the Year for 1945. In 1953 she became the first woman president of the Indianapolis Jewish Welfare Federation. In 1956, the Post referred to her as “without a doubt the most prominent Jewish woman in the state” and in 1958 she became chairman of the United Jewish Appeal.

At her 85th birthday, she looked back on her accomplishments, and perhaps to the 1938 drive to save the children of Austria. She stated:

Anything one does that helps in any way to make the life of another more livable is the greatest reward one can reap. My interest is in the dignity of man – regardless of his denomination.

Monster Meetings at the Senate Avenue YMCA

Two or three black men brought segregation of Indianapolis’s YMCA into sharp focus in 1888, when they attempted to join the organization. Although the YMCA lacked an official policy mandating segregation, they denied the black mens’ applications. Two years later, a group of African American men formed a Young Men’s Prayer Band in Indianapolis. By 1902, this band merged into a “colored Y.M.C.A.”

The Y opened at the tail end of a major influx of African Americans to the city following the Civil War and Reconstruction. In the forty years between 1860 and 1900, the African American population of Indianapolis grew 3,000 percent. Many white residents did not welcome these newcomers. Oftentimes, African Americans were relegated to segregated areas of the city due to housing discrimination and exclusion from facilities. Indiana Avenue was at the center of the largest African American community in the city, with 30,000 black residents living within a ten mile radius of the Avenue by the 1950s.

The establishment of this YMCA provided facilities for those men who had been excluded from the central organization. In an Indiana Magazine of History article, Dr. Stanley Warren points out that:

the necessity of finding a way to survive within a limiting system driven by segregationist tendencies has been the base from which many great African-American traditions and organizations have begun.

In the capital city, the organization then called “The Indianapolis Colored YMCA” served as an example of these great African-American traditions. Emerging out of the discriminatory practices of Indianapolis, this branch of the “Y” grew into one of the largest and most influential black YMCAs in the country.

Before that could happen though, they needed a building able to accommodate their rapidly growing membership. By 1911, just nine years after its formation, the YMCA outgrew its building located at California and North Streets in the city. To remedy this, they proposed the construction of a new building. The building cost an estimated $100,000, a figure that seemed unobtainable to many in the community, where even the working professionals barely got by due to the limited job opportunities available to them.

Fortunately, just as the YMCA members began to plan their fundraising strategy, they gained a rather unlikely ally in a white, Jewish, Chicago businessman. Julius Rosenwald, part-owner of Sears, Roebuck, and Company, announced that he would give $25,000 to any community able to rise $75,000 towards the construction of a Colored Young Men’s Christian Association. With this support, members of the Indianapolis Colored YMCA joined forces with the white members of the Central YMCA for an incredible fundraising push. Two teams formed, one for the white members and one for the black members, and they set out on their mission. In just ten days, they surpassed their $75,000 goal. African American entrepreneur Madam C.J. Walker was one of the largest contributors to the YMCA’s Building Campaign Fund.

On July 28, 1912, with a crowd of over 5,000 people in attendance YMCA committee men broke ground on the site of the new building. Three months later another celebration with thousands of spectators was held for the laying of the cornerstone. Workers completed construction on the building, located at the corner of Michigan Street and Senate Avenue in downtown Indianapolis, in July 1913.

YMCA members held a week of festivities and ceremonies in celebration of the opening of the new Senate Avenue Y, as it was called. Celebrations-attended by both black and white residents-included a ladies night, fraternal night, and athletic night. The highlight of the week, though, was Tuesday July 8 – the official dedication, which featured an address by Booker T. Washington, civil rights activist and founder of Tuskegee institute.In his address, Washington commended the citizens of the city, black and white, for banding together to make the Senate Avenue Y a reality. Then, he said:

I am proud of being a member of the Negro race and never
more so than tonight. I spurn the men who sympathize with me because I am a member of the Negro race. We have work to do and difficulties to overcome . . . Let the white people know about the good deeds in our race. In too many cases white people hear only of crime. They do not hear about the hard-working, industrious, sober colored men, and Indianapolis has many of the latter class.

In many cases, African American churches were the heart of the black community. The Indianapolis Colored YMCA, itself a Christian organization, became another center of the African American community in Indianapolis. Majority black neighborhoods such as this did not have access to the same social, recreational, and charitable organizations as the white communities. Because of these segregationist policies, black communities had long provided these facilities for themselves, often led by their churches. This is where the Senate Avenue Y stepped in, building on and expanding the work of African American churches.  The Senate Avenue Y was located in the heart of the Indiana Avenue African American community and offered adult education classes, held bible studies, provided meeting space for a variety of organizations, and even established an amateur basketball team.

According to historians, these Senate Avenue programs:

fostered self-respect and self-reliance and tried to provide young men with proper role models and male companionship . . . [they] served as sanctuaries which preserved African American Masculinity and prepared black men and boys for their leadership role in the struggle for equality that lay ahead.

In order to reach more and more young men and boys, the Y held annual membership drives. These campaigns borrowed military organizational structures, dividing members into divisions of “enlisted men.” These men worked hard to recruit as many new members as possible. Those groups that enlisted the most new members were inducted into the Society of High Producers and The Royal Order of the Spizzerinktum, meaning “the will to succeed.” These tactics worked fabulously; membership jumped from just fifty-two in 1903 to over 5,000 by 1930.

These wildly successful membership drives turned the Senate Avenue Y into one of the largest African American YMCA branches in the country. But being large does not necessarily make an organization important or influential. To understand the influence of the Y, we need to go right back to the very beginning of the branch, to the establishment of Monster Meetings.

The roots of the Senate Avenue YMCA Monster Meetings can be traced to the very early years of the Indianapolis Colored YMCA, and executive secretary Thomas Taylor. He instituted public forums where men, and later women, could gather on Sunday afternoons between November and March to listen to lectures on a wide variety of topics. Originally, Taylor wanted to call the forums “Big Meetings” but the proposal was rejected by the Central YMCA board because their annual meeting was already being called the Big Meeting. So, Taylor one-upped them and labeled his forum series the “Monster Meetings.” Taylor could not have known how fitting that name would become.

In the Taylor years, the meetings featured local religious leaders speaking almost exclusively on religious matters, but in 1916 a new executive secretary took the meetings to a new level. That executive secretary was Faburn Defrantz. (In 1947, he successfully spearheaded the effort to convince IU to allow African American basketball player Bill Garrett to play for the school’s varsity team. A “gentleman’s agreement” had barred African Americans from playing in the Big Ten).

During DeFrantz’s tenure, Monster Meetings continued to feature local ministers delivering religious messages. But they soon expanded to include some of the most well-known African American leaders in the nation, speaking on a variety of hot-button issues. In his seminal article “The Monster Meetings at the Negro YMCA in Indianapolis,” Dr. Stanley Warren provided a list that sampled some of the hundreds of speakers and topics featured at Monster Meetings during the DeFrantz years. These included authors, NAACP leaders like Walter White, professors, university presidents, politicians like Governor Paul V. McNutt, newspapermen, famous athletes such as Olympic gold medalist track star Jesse Owens, religious leaders, and former First Lady Eleanor Roosevelt. Unfortunately, I have not located a collection or archive containing the speeches given at these Monster Meetings. Luckily, some snippets of some of the lectures are preserved in the pages of newspapers like the Indianapolis Recorder.

The lectures bespoke major events and concerns of the period. In 1930, months after the 1929 stock market crash, Freeman B. Ransom, attorney for the Madam C. J. Walker Company, discussed “Unemployment and How to Solve It.” In 1931, during the Prohibition Era, Reverend Charles H. Winders and Boyd Gurley debated the question “Prohibition: Shall Indiana Stay Dry?” Dr. George Washington Carver, Director of agricultural research and professor of chemistry at Tuskegee University, asked in 1932 “Great Creator, What Is a Peanut, Why Did You Make It?”

In 1940, as World War II raged in Europe, Dr. Max Yergan spoke on “Democracy: A Goal to Defend.” After U.S. entry into World War II, Dr. Lorenzo Greene spoke on “The Negro in National Defense,” Phillip Randolph lectured about “The Negro in War and Peace,” and William Hastie discussed “The Fight Against Discrimination in the Armed Forces.”

In 1947, one year after the Froebel School Board in Gary, Indiana voted for desegregation after hundreds of white students staged a walk out in protest of integration, Joseph Chapman spoke on “Democracy in Gary Schools.” In the early Cold War era, Former Crispus Attucks teacher and the first African American woman to study at the University of Oxford spoke about “Education and International Good Will” in 1952. Former First Lady Eleanor Roosevelt spoke to a desegregated audience at the Murat Temple about “International Human Rights” in 1953.

And finally, leading up to and during the Civil Rights Movement, speeches such as “Integrated Society or a Segregated Society,” “The Civil Rights Crisis and American Democracy,” and “The Civil Rights Resolution in America” demonstrated that the black citizens of Indianapolis’s discussed and debated the same issues as those around the nation. The following details some of the most prolific speakers at the Monster Meetings:

Dr. Mordecai Johnson was a fixture of the Monster Meeting schedule, opening the meeting season for over forty consecutive years. He got involved with the YMCA in 1916, when he served as a student secretary and became a life-long supporter of the association. In 1926, Dr. Johnson became the first African American president of Howard University, one of the nation’s historically black universities. He served in that capacity until 1960. During his decades speaking at Monster Meetings, he covered a wide range of topics, including:

  • “Anti-Semitism and the Negro Ministry”
  • “Civilization’s Civil War”
  • “Implications of the Atomic Bomb”
  • “Ghandi and the Liberation of India”
  • “Segregation is Suicide”

Described as a man who “made people listen even when they did not believe,” Johnson was a powerful speaker and he lent his skill to important topics. As Cold War tensions mounted, he spoke of the dangers American segregation posed to the nation. He said:

“Through our nation’s moral weakness caused by segregation, we are committing scientific and technical suicide. We are five years behind militarily due to this moral weakness. Oh my brothers, let us pray it is not too late – only Almighty God knows whether it is not too late already…”

He went on to address the recent affirmation of Brown Vs. Board of Education, which declared segregated schools unconstitutional.

“It is my judgement that the death knell of segregation has been sounded. I see no disposition on the part of the Supreme Court to yield to the opponents of integration. The Court is informed by a sense of world duty which is inexorable.”

Another name that appears more than once in the list of prominent figures featured at Monster Meetings is that of A. Philip Randolph. In 1925, Randolph organized the Brotherhood of Sleeping Car Porters, the first labor union comprised principally of African American workers. A major civil rights activist, he played a large part in pressuring President Franklin Roosevelt to issue an Executive Order that banned discrimination in World War II defense industries. He also pressured President Harry Truman to issue an Executive Order that ended segregation in the armed forces. (The 1945 Freeman Field uprising in Seymour, Indiana, where Tuskegee Airmen protested illegally-segregated officers’ clubs by forcibly entering the white officers’ club, also played a large part in Truman’s Executive Order). Randolph was not satisfied with those successes, though. In 1955, he stood in the Senate Avenue YMCA and declared:

“Negroes are yet second class citizens. Civil revolution was never completed, free public schools were never established, Negroes cannot buy property where they wish, nor can they enter certain businesses. They cannot join all the various unions. The Negroes cannot vote in some parts of this county; therefore they are not yet free.”

Later, in 1963, Randolph organized the March on Washington, where Reverend Martin Luther King Jr. delivered his “I Have A Dream” speech, which highlighted the injustice of many of the same racist, segregationist policies Randolph underscored in his Monster Meeting lecture.

In 1958, Martin Luther King Jr. himself, made an appearance on the YMCA Monster Meeting roster with a speech entitled “Remaining Awake through a Revolution.” Due to intense interest in King’s lecture, organizers moved the event to Cadle Tabernacle, which could accommodate a larger audience. In one of his first public appearances since he suffered a brutal attack at a book signing that year, the Baptist minister maintained his message of nonviolence, urging the use of love in the face of violence. He proclaimed:

“A new age of justice is challenging us to love our oppressors . . . We must not assume this new freedom with attitudes of bitterness and recrimination, for, if we do, the new age will be nothing but a duplicate of the old one . . . A new world is being born, and the old world will die. We must be prepared for the new world to come. Segregation is nothing but slavery covered up with certain niceties and complexities. If our democracy is to live, segregation must die . . . Use love. Love is a sure winner. Remember that as Christians we are working with god. If we do it the way God wants us to do it, we will be able to sing with pride, ‘My Country ‘tis of thee’ for Freedom must ring from every mountainside.”

The Senate Avenue YMCA Monster Meetings played a central role in not only educating members about topics of local, national, and international importance, but also in galvanizing the community into action. According to Dr. Warren, “As the popularity and importance of these mass education meetings grew, both the public and YMCA members exhibited a higher level of community activism.” For those who regularly attended Monster Meetings, the YMCA became a foundation for the changes that they worked towards in the coming decades. The meetings were a place where, in the words of Dr. Mordecai Johnson, “The redcap and the lawyer, the laborer and the doctor, seek together to find answers to social and political questions.”

They agreed that black prisoners should receive fair trials, that black Americans should not die years earlier than white counterparts, that black workers should be afforded a living wage, and that black candidates should be given opportunities to craft legislation that affected their communities. They shared a collective outrage. In 1972, organizers asked them – Americans of color affiliated with Socialists, Democrats, Republicans, Nationalists, and the Black Panthers- if they could overcome differing ideologies to channel this outrage into political action at the National Black Political Convention (NBPC) held in Gary, Indiana. Black poet and activist Amiri Baraka (formerly LeRoi Jones) advocated for the gathering to practice “unity without conformity.”

According to an essay in Major Problems in African American History, the Gary convention was the culmination of a series of uprisings in protest of discrimination, which historians refer to collectively as the Black Revolt. Black Americans were emboldened by tragic events, such as the assassination of Malcolm X in 1965, as well as legislative progress, like the Voting Rights Act of 1965.  In an interview, North Carolina convention delegate Ben Chavis recalled:

I had gotten tired of going to funerals. . . . so much of the Movement had been tragic. You know. And I have to emphasize [Rev. Martin Luther] King’s assassination was a tragic blow to the Movement. And so four years later, March of ’72, for us to be gathering up our wherewithal to go to Gary, Indiana–hey, that was a good shot in the arm for the Movement.

Historian Stephen Grant Meyer identified 1968, when King was assassinated, as the year in which the modern civil rights movement began to diverge. No longer was integration the primary means to make political and economic gains.  This fracture gave rise to a Nationalist faction, which sought to promote black identity and improve living conditions through a separate black nation. The polarization was reminiscent of the late-19th and early-20th century debates between reformer Booker T. Washington and intellectual W.E.B. Du Bois, who both worked to ease the economic and social plight of African Americans. Washington believed this was best achieved by earning the respect of white citizens through hard work and self-help. Du Bois, on the other hand, believed white oppression should be cast off by protests and political activism, in large part through the National Association for the Advancement of Colored People (NAACP), an organization he co-founded.

NBPC organizers, who had begun planning the conference in 1970, struggled to find a city willing to accommodate an influx of politically-engaged black Americans. Gary Mayor Richard G. Hatcher, an advocate of civil rights and minorities and one of the first African American mayors of a major U.S. city, volunteered his predominantly black city. Not since the 1930s, with the first meeting of the National Negros Congress in Chicago, had such a massive and diverse gathering of people of color convened to advance their rights. Approximately 3,000 official delegates and 7,000 attendees from across the United States met at Gary’s West Side High School from March 10 to March 12. The attendees included a prolific group of black leaders, such as Reverend Jesse Jackson, Coretta Scott King, Amiri Baraka, Muslim leader Minister Louis Farrakhan, Black Panther co-founder Bobby Seale, and Malcolm X’s widow Betty Shabazz. Organizers sought to create a cohesive political strategy for black Americans by the convention’s end.

A bomb threat was called into convention headquarters at the Holiday Inn and a local gang reportedly deposited guns in school lockers. These threats to disrupt the convention necessitated additional security. Uniformed and plainclothes policemen reinforced the northwestern Indiana city. Armed civil defense personnel supplemented the police presence and boxer-turned-activist Muhammad Ali served as sergeant-at-arms.

The high school, decorated with red, white, and blue bunting, thrummed with activity. As vendors sold books, banners, and souvenirs, a band prompted snapping and feet-tapping with “gutsy,” drum-driven music. The Munster Times reported “Two or three white reporters, their faces split with grins, were lost somewhere with the music. A policeman absentmindedly slapped the butt of his pistol to the beat.” Delegates ranging from “pinstripe-suited conservatives to youngsters in colorful flowing robe-type shirts [dashikis] and mod fashions to the black-uniformed para-military” milled about the gym waiting for the delayed convention to finally start. Organizers scrambled to respond to complaints that the elevated platform for journalists blocked the stage.

Entertainers like James Brown and Harry Belafonte lent their support to the convention by performing. Comic and civil rights activist Dick Gregory, weighing 90 pounds as a result of fasting to protest the Vietnam War, addressed the audience about issues of policing and drug access and asked, “‘[H]ow can a black kid in Harlem find a heroin pusher and the FBI can’t?'”

State delegations, national organizations, and individuals proposed resolutions in the creation of “A National Black Agenda” (Muncie Evening Press). This agenda would extend the movement beyond the convention. As convention attendee and Distinguished Lecturer at York College City University of New York Dr. Ron Daniels noted, the Black Agenda was “integral to holding candidates, who would seek Black votes, accountable to the interests and aspirations of Black people.”

Delegates from Illinois suggested fines and prison sentences for businessmen found guilty of discriminatory practices. North Carolina attendees proposed a bill of prisoners’ rights that included humane treatment and fair trials. Delegates from Indiana and other states demanded that the U.S. dedicate resources to the plight of black Americans rather than the Vietnam War and end the conflict immediately. North Carolina representatives also urged that black men receive Social Security benefits earlier than white men since their life expectancy was eight years shorter. The Muncie Evening Press noted that “Politicking was intense . . . as state delegations tried to compromise their own views with positions they felt other delegations could support.” Tensions ran so high that part of the Michigan delegation walked out of the convention.

Keynote speakers Reverend Jackson, executive director of P.U.S.H. and Operation Breadbasket, and Mayor Hatcher ignited the crowd and “stoked rhetorical fires aimed at molding the diverse black communities represented here into a solid unit that can tip the political balance this presidential election year and from now on” (Munster Times).

While similar in many aspects, the men’s speeches hinted at the divergence in philosophies pervading the convention. Hatcher believed change could come from within the existing two-party system, so long as the parties responded to the needs of African Americans. However, if legislators continued to neglect black constituents, black Americans would create a third party and, he told attendees, “we shall take with us the best of White America . . . many a white youth nauseated by the corrupt values rotting the innards of this society . . . many of the white poor . . . many a White G.I. . . . and many of the white working class, too.” The party would also welcome “chicanos, Puerto Ricans, Indians [and] Orientals” (Indianapolis Recorder).

However, Jackson, appealing to Nationalists, urged the immediate formation of a black party, potentially called the “Liberation Party.” He asserted “‘Without the option of a black political party, we are doomed to remain in the hip pocket of the Democratic party and in the rumble seat of the Republican party'” (Kokomo Tribune). Jackson also called for the establishment of black institutions to oversee black educational, economic, and judicial matters. He asked the crowd “what time is it?” and the audience, electrified, shouted “It’s Nation Time!”

Jackson’s proposal drew criticism from some black organizations, like the NAACP, which believed that continued segregation, albeit black-led, would impede progress. According to Major Problems in African American History, the NAACP circulated a memo at the convention denouncing the proposal of a separate nationhood for African Americans and criticizing the rhetoric for being “‘that of revolution rather than of reform.'” An Indianapolis Recorder editorial articulated this point, noting “The only road to nationwide achievement by a minority is through cooperation with the majority.”

Another contentious issue in the 1970s: school desegregation through the forced busing of black children to white schools. The Jackson faction opposed busing and defined successful black education not as being able to attend white schools, but rather as children attending black-led schools. The endorsement of the presidential candidate that would best represent black interests also generated conflict at the convention. Some delegations supported Democrat Shirley Chisholm, America’s first black Congresswoman, while many Nationalists wanted a leader from a black party.

After intense debate, a steering committee tentatively adopted a National Black Agenda. The committee officially published the 68-page document on May 19, Malcolm X’s birthday. The resolutions included black representation in Congress proportionate to the U.S. black population, a guaranteed minimum income of $6,500 for four-person households, a 50% cut in the defense and space budgets, and an end to national trade with countries that supplied the U.S. drug market. The resolutions, designed to move black Americans towards “self-determination and true independence,” represented major, yet tenuous compromise among the black community.

The steering committee also formed the National Black Political Assembly, a body tasked with implementing the Black Agenda. Dr. Daniels noted that, although many of the agenda’s resolutions never materialized, “thousands of Black people left Gary energized and committed to making electoral politics a more relevant/meaningful exercise to promote Black interests.” He attributed the quadrupling of elected black officials by the end of the 1970s, in large part, to the Gary convention and the “audacity of Black people to . . .  defend black interests.” The NBPC was notable too for its inclusion of black Americans from all walks of life, rather than just prominent black figures, in formulating how to ease the struggles of the black community. The Recorder also noted that Mayor Hatcher’s reputation “has been considerably burnished in the white community as well as the black by the success of the historic event” (Indianapolis Recorder).

In 2012, Gary hosted the 40th anniversary of the National Black Political Convention. Speakers discussed the issues that had prevailed into the 21st century, such as a disparity in prison sentencing and poverty. One speaker remarked that without Shirley Chisholm, America’s first black president Barack Obama would not have occupied the White House. Another speaker, who ran for mayor of Baltimore, lamented that forty years after the convention “we’re still asking what to do instead of how to do it.” When asked if it was still “nation time” one speaker responded “it’s muted nation time.” Black Americans, they agreed, needed to “have the audacity.”

Before It Was Legal: a black-white marriage, 1945-1987

Twenty-two years before Loving v. Virginia, Anna Harley, a white woman, and Daniel Winters, an African American man, sacrificed family, friends, and even country, to live together as husband and wife. In 1986, the Winters allowed me to interview them at their Mexico City home. It took me nearly 30 years to write Before It Was Legal: a black-white marriage (1945-1987). As the trust between us developed and they shared a part of their life they’d intended not to speak of, theirs became a more difficult narrative to put to paper. Looking back on their forty-two-year marriage—a tape recorder between them on their green sofa—they reflected on their relationship with startling honesty.*

On February 2, 1945, the Richmond, Indiana couple drove to Chicago, where they could legally marry. In Indiana “marriage between a white person and a person with one-eighth or more Negro blood” was a felony, punishable by a heavy fine, imprisonment, and the voiding of the marriage. Not until two years later, when Daniel’s mother, in Richmond, became ill, did the couple return to Indiana. During the eleven years they lived there, they were never prosecuted, but faced persecution.

Daniel was born in Richmond in 1908. The town he remembered was as segregated as most southern cities, with restaurants, beaches, and hotels off-limits to the city’s black population. When African American celebrities like Louis Armstrong, Joe Lewis, and Marian Anderson, visited the Indiana city they had to spend the night with a local widow, who rented out rooms.

A precocious child and an outstanding athlete, Daniel wasn’t bothered by the community’s discrimination until he was old enough to participate in team sports at school. A particularly painful memory included a frigid evening in which he had to change into his basketball uniform outside in the shadows of the YMCA building, because the association prohibited him from using its locker room. Although he took all of the advanced classes in high school, his white teachers never encouraged him to attend college. Yet in 1933, during the Great Depression, he graduated from Earlham College with a teaching degree in Spanish. While at the school, President William Cullen Dennis’s office chided Daniel for walking into town with groups of white women on his way home from classes. Daniel could not participate in Earlham’s social events that took place at the YMCA or Richmond hotels. After a long period of working menial jobs, he was able to teach Spanish in the federally-funded Works Progress Administration (WPA) program.

Anna, born near Lima, Ohio, was seven when her mother died. Six years later her father took off to California without her. Abandoned, she went to live with her older sister, Violet, in Brookville, Ohio, near Dayton. She grew up independent and with an adventuresome spirit. Following her 1938 graduation from Manchester College, in Indiana, she became a social worker.

Daniel and Anna met in Richmond. The WPA office he worked out of was located in the same building as the Unemployment Relief Agency, which Anna supervised. A gregarious man, Daniel went downstairs to visit the young women who worked there. He and Anna began meeting at night in the privacy of her car, where they talked, kissed, and held each other. When Anna was transferred to northern Indiana and attended meetings in Indianapolis, Daniel rode there by bus. Indianapolis was large enough for them to appear in public and maintain anonymity. Yet people stared when they walked arm in arm along the sidewalk. Men sneered, “whore” in passing.

Only one of Anna’s friends, Inez, met Daniel before the marriage. Inez was quickly drawn to his charm and urbane demeanor, but she warned in letters that Anna should follow her head instead of her heart. A daughter of Anna’s sister, Violet, later said, “Mom practically had a nervous breakdown,” upon learning of the approaching marriage.

With World War II boosting production, International Harvester hired Daniel as a janitor at its Richmond plant- some company leaders were convinced that African Americans lacked the intelligence to operate machinery. The labor union, however, valued his education and elected him to leadership positions. During the McCarthy era, like other union activists, he was labeled a communist and intimidated by the FBI.

When Harvester closed its Richmond plant in 1957, no one in town would hire the “n— commie troublemaker.” By now the family included two school-age daughters. A move to Mexico offered Daniel the opportunity to practice the profession he’d been trained for and their daughters a chance to grow up free of racial prejudice.

But the move put new stressors on the couple’s relationship. Daniel, who taught English at a prestigious boys’ school, was soon saying he felt “as Mexican as chili verde.” Anna, a reserved, blond woman, felt at odds with the effusive culture whose language she never fully mastered. Daniel resented her not being outgoing; she resented his making little effort to help her adjust.

While personal in nature, Daniel’s and Anna’s story is also cultural. It speaks to the discriminatory attitudes resulting from the Ku Klux Klan’s influence during the 1920s and of McCarthyism in the 1950s. It is not the happily-ever-after story I anticipated, but an honest portrayal of the love and hurt any two people, not just a biracial couple, can encounter in an intimate relationship.

Democracy for Some: Defining the Indiana Landscape through the Rectangular Survey System

A small group of men made their way through the thick southern Indiana forest dragging chains in their wake. Once in a while, they stopped to score a tree, plant a post, and record their progress. For those residents of the Indiana Territory who witnessed this bizarre parade in the fall of 1804, this group represented vastly different futures. For Thomas Jefferson and other leaders of the young United States, this group of men sent to survey the Indiana Territory represented the spread of democracy. For the indigenous people who first called this land home, the marks cut and burned into the trees represented the impending and permanent loss of that home. Despite their disparate perspectives, both would soon see the redefinition and reorganization of the landscape by the rectangular survey system.

After the American Revolutionary War and via the 1783 Treaty of Paris, the British surrendered their claim to the thirteen colonies and ceded a vast amount of western and southern territory to the young United States. In order to grow the republic and repay war debt, the new government needed a system of organizing this land for sale. In response to these needs, the Continental Congress created a committee chaired by Thomas Jefferson to create a system for surveying the new territory.

Jefferson passionately believed that the system had to make small plots of land available to the individual farmer (as opposed to large plots available only to the wealthy, to speculators, or to large companies) in order to spread democracy throughout the territory. In 1785, Jefferson wrote:

We have now lands enough to employ an infinite number of people in their cultivation. Cultivators of the earth are the most valuable citizens. They are the most vigorous, the most independent, the most virtuous, and they are tied to their country and wedded to it’s [sic] liberty and interests by the most lasting bands.

The committee’s answer was the Land Ordinance of 1784 which attempted to define and standardize surveying methods to create a grid of small plots of land across the territories. These surveyed squares could then be subdivided, numbered, and recorded for sale. In this manner, the landscape could be divided and sold to settlers unseen — that is, without the surveyor having to physically walk the entire area, mapping the land in the old system of metes and bounds (which used natural markers like trees and rivers to define property). This older system was time consuming, required the surveyor’s physical presence in a sometimes dangerous landscape, and often led to land disputes as natural markers were altered or disappeared. While the 1784 Ordinance did not become law, it did define the rectangular system and laid out the principles that would measure and divide the landscape into what it is today.

On May 20, 1785, Congress passed the Land Ordinance of 1785, a revised version of the 1784 plan which further described the system and codified a detailed survey plan which used mathematics and standardized chains for measuring. The ordinance stated that surveying would begin on the Ohio River, at a point that shall be found to be due north from the termination of a line which has been run as the southern boundary of the state of Pennsylvania.” According to historian Matthew Dennis, this rectangular survey system allowed the leaders of the young government to apply  their “nationalistic, scientific, and engineering mentality in transforming the continental landscape of North America, reconceptualizing its space, subduing and organizing it, and distributing it to white yeoman farmers in the interest of national expansion, and, they believed, democracy.”

The removal of the native tribes living in the territories was the first step of the survey process.  Both the proposed 1784 Land Ordinance and the adopted 1785 Land Ordinance called for American Indian removal. The United States government worked towards this end through both military action, economic pressure, and treaties in order to make space for white male settlers to farm the land. On July 13, 1787, Congress passed the Northwest Ordinance, an act which created the Northwest Territory (an area that would become the states of Ohio, Indiana, Illinois, Michigan, Wisconsin, and part of Minnesota) and provided a system for settling the area to create new states.

The U.S. government viewed conflict with indigenous populations in the area as the greatest obstacle to the expansion and settlement of white Americans in the territory. According to historian Eric Hemenway of the Little Traverse Bay Bands of Odawa Indians:

Between 1774 and 1794, Indian villages in New York, Pennsylvania, Indiana and Ohio were constantly attacked by the American army and militias. The Shawnee, Delaware, Iroquois, Miami, Odawa, Wyandot and Mingo saw unspeakable violence committed against their villages during this time period. Over 100 Indian villages were burned and destroyed, leaving an unknown number of civilian casualties.

The U.S. government applied military, economic, and diplomatic pressure on native peoples to cede land and create a peace, no matter how tenuous. The military pressure was applied by President George Washington’s assignment of General Anthony Wayne to battle a confederacy led by Miami, Shawnee, and Lenape (Delaware) chiefs. After suffering major losses at the 1794 Battle of Fallen Timbers, many tribes living in the Northwest Territory were resigned to settling for peace. This resulted in the 1795 Treaty of Greenville, in which some tribal leaders ceded large sections of land in Ohio and Indiana to the United States and opened much of the area to white settlement. Many Wyandot, Delaware, Shawnee, Ottawa, Miami, Eel River, Wea, Chippewa, Potawatomi, Kickapoo, Piankashaw, and Kaskaskia lost large portions of their homeland. Still other native leaders resisted and contested this and subsequent treaties, and would later fight to regain their land under the leadership of Tecumseh and Tenskwatawa.

While the U.S. government offered payment in goods for signing the treaty, some Native Americans became dependent on these annuities as the land on which they made their living was taken from them. In some cases, they fell into debt and lost even more land as a result. This situation was often exploited by the United States government. For example, in 1803, President Thomas Jefferson wrote William Henry Harrison:

We shall push our trading houses, and be glad to see the good and influential individuals among [Great Lakes Indians] run in debt, because we observe that when these debts get beyond what the individuals can pay, they become willing to lop them off by a cession of lands.

After the Treaty of Greenville provided prospective colonists the security of peaceful settlement, Congress passed the Land Act of 1796. This legislation provided for the sale of land in the Northwest Territory. It reiterated that surveys would be conducted in areas “in which the titles of the Indian tribes have been extinguished.” It also appointed a Surveyor General directed to employ deputy surveyors.

General Rufus Putnam, a Revolutionary War veteran and an organizer of the Ohio Company, became the country’s first Surveyor General in 1796. Jefferson, however, became unhappy with Putnam’s irregular results and soon began to seek a more mathematically minded candidate who could factor in the curvature of the earth among other issues. Jared Mansfield (1759-1830) came to the attention of President Jefferson in 1801 upon the publication of his book Essays, Mathematical and Physical, one of the earliest works of original mathematics by an American. On May 21, 1803, Jefferson wrote to Mansfield, and conveyed his disappointment with Putnam for errors in “laying off the townships, not having been able to run parallel East & West Lines.” Jefferson expressed his confidence in Mansfield: “I am happy in possessing satisfactory proof of your being entirely master of this subject, and therefore in proposing to you to undertake the office.” Mansfield began his work as Surveyor General in the fall of 1803 as Congress and other U.S. government officials worked to open up the territories to settlement.

The land which would become Indiana was difficult to survey because much of it had yet to be acquired through treaty. The Vincennes Tract, an area ceded by local tribal authorities to French settlers in 1742, provided another unique obstacle. This area ran along the Wabash River and thus had been surveyed at an angle, and French settlers acquired titles to the land based upon this survey. Since 1787, the inhabitants of the Vincennes Tract regularly petitioned Congress to validate their titles. In May 1802, Congress determined that the territory should be surveyed by the rectangular method except where it had been previously surveyed. In other words, the Vincennes Tract would sit like an oddly angled puzzle piece within the rest of the rectangular pieces. The lines forming the rectangles would stop at the edge of the Vincennes Tract and then continue after it on all sides. According to survey historian Bill Hubbard, since the purpose of the rectangular survey was to organize the land for sale, there was no need to resurvey the tract.

Meanwhile, in March 1803, Ohio attained statehood, which left the rest of the former Northwest Territory as the Indiana Territory. Congress wanted the Indiana Territory surveyed in full in preparation for American colonization. In June 1803, the Vincennes Tract’s boundaries were confirmed through Indian treaties and the edges surveyed. Surveying the Indiana Territory around the irregular tract became Mansfield’s first challenge as Surveyor General. U.S. government officials assumed it was a matter of time before the rest of the territory would be acquired from the Native Americans, and thus Mansfield needed to develop a technique for surveying this vast landscape that did not include the time-consuming and even dangerous physical trek through the entire landscape measuring with steps and chains. Instead, he determined that he could create a meridian and a baseline ran off the corners of the Vincennes Tract which would be the foundation of a grid made up of six-mile by six mile square plots of land called townships.

Mansfield planned a baseline that would start at the southwestern corner of the Vincennes Tract and run east-west to the edge of the territory and a meridian which ran from the southeastern edge of the tract north through the territory. The north-south line was called the Second Principal Meridian and coincides with 86° 28’ west longitude. The base line coincides with 38° 28’ 20” north latitude and became known locally as Buckingham’s Base Line. From the intersection of these lines, survey lines could be calculated every six miles in all four directions to create the grid of townships. Each township could then be further divided into one mile squares creating thirty-six sections of land. Each section contained 640 acres of land which could then be divided further in half, quarter, half-quarter, and quarter-quarter sections as needed. These plots would then be numbered and sold to settlers without the surveyor hiking the entire territory, the running of the two lines being the only physical surveying needed.

While Mansfield mathematically planned the baseline which would serve as a foundational line for the survey of the Indiana Territory, someone still had to mark the line into the landscape and take measurements. That task fell to a small crew led by deputy surveyor Ebenezer Buckingham, Jr., and he would long be remembered for his efforts. Originally from Connecticut, Buckingham migrated to Ohio in 1796 and began work as a farmhand for General Putnam. He assisted Putnum on survey trips in several Ohio counties, and in 1799, Putnam swore in Buckingham as a deputy surveyor.

In 1804, Mansfield appointed Ebenezer Buckingham to lead a crew to run the base line. They began at a point on the south-side of the Vincennes Tract and ran a line east for 67.5 miles, marking off miles and half-miles on trees. Buckingham and crew then went to the southeast corner of the Vincennes Tract and ran a line due north until they reached the baseline. When they intersected the baseline, they marked the initial point. Then, they marked section corners and half-section corners until they reached the east end of the Vincennes Tract again. They packed up for the winter and returned the next season to finish extending the baseline east twelve miles and the meridian north in September 1805. The placement of the baseline and meridian in these locations allowed Buckingham and his crew to lay the foundations for the survey system and include the Vincennes Tract in it, all without encroaching on lands that still belonged to Native Americans. After this, the townships could be numbered and the land further divided. The township numbers would be increased east and west away from the Principal Meridian and be numbered away from the Baseline north and south, starting at the Initial Point where the two lines crossed.

Because the rectangular survey clearly mapped the land, organized, and numbered it, settlers knew that any land they purchased had a secure title. This was not true in states not mapped in such a standardized way.  For example, in Kentucky, the same land was sometimes surveyed multiple times in different ways giving rise to title disputes. For example, in 1808, a carpenter and cabinet maker named Thomas Lincoln purchased a farm near Nolin Creek, Kentucky. The following year, in the cabin that Thomas built on his land, his son Abraham Lincoln was born. The family soon moved to another farm, along Knob Creek for which Thomas paid cash years later in 1815. However, the titles of both his farms were challenged by competing claimants. According to Abraham Lincoln biographer William E. Gienapp, because Thomas did not have the resources to fight a possibly extensive court battle, “he simply sold out at a loss and in December 1816 moved to Indiana, where the federal government had surveyed the land.” Thus, the survey system played no small role in bringing the studious young man who would become the sixteenth President of the United States to Indiana.

The legacy of the survey system still defines how Hoosiers interact with the landscape today and is seen in our counties, townships, and the quilted pattern of Indiana farmland. In fact, much of the country is organized by this system. According to historian Michael P. Conzen, “Except for the original 13 colonies, Texas, and some western mountainous areas, most of the country is parceled out on the township and range system.” The methods perfected by Mansfield and executed by men like Buckingham were applied throughout the vast landscape of the United States to the benefit of some and the anguish of others. In 2018, IHB will place a state historical marker for Buckingham’s Base Line in Dubois County at one point of the line, literally inserting the story of this complex landscape back into the landscape itself – a reminder that as Hoosiers we share both the legacy of those industrious settlers who arrived following a dream of a better life in a bright new democracy and the legacy of those native peoples who were harmed to make that dream a reality.

Charles Gordone: Finding His Place to Be Somebody

The unified efforts of the Civil Rights Movement began to fracture when in 1966 a new strategy and ideology emerged, known as the Black Power Movement.  This new movement also influenced the development of the Black Arts Movement.  According to historian Ann Chambers, the Black Arts Movement did not speak for the entire black community; however, the movement gave a “new sense of racial pride to many young African-American artists.” One African-American writer and actor who opposed the Black Arts Movement was Pulitzer Prize winning playwright, Charles Gordone.

Gordone was born Charles Fleming in Cleveland, Ohio, on October 12, 1925.  In 1927, his mother moved with her children to Elkhart, Indiana.  By 1931, she married, changing Charles Fleming’s name to Charles Gordon.  He attended Elkhart High School and, although popular at school, faced racial discrimination while living in Indiana because of the divide between white and African-American children.  According to Gordon, both races rejected him.  White children avoided him because he was black, and the town’s African-American community shunned him because his family “lived on the other side of the tracks and . . . thought we [the Gordons] were trying to be white.”

After serving in the US Army Air Corps, he enrolled in Los Angeles City College, and graduated in 1952. Gordon stated that he majored in performing arts because “I couldn’t keep myself away from the drama department.”  His experiences in college influenced his outlook on race in America.  Gordon stated “I was always cast in subservient or stereotypical roles,” and he began wondering why he was not given prominent parts in Shakespeare, Ibsen, Strindberg, Pirandello plays. After graduation, Gordon moved to New York City. Once on the east-coast, Charles Gordon added an “e” to the end of his name, and became Charles Gordone when he joined Actor’s Equity Association; a labor union for theater actors and stage managers.

Two months after Gordone’s arrival in New York, he performed in Moss Hart’s Broadway play, The Climate of Eden, the “first of many Broadway and off-Broadway productions” for Gordone. He soon realized that black actors had a hard time earning a living in the entertainment business, and he claimed he “began to get really intense” about the lack of acting jobs for African Americans.  He started conversing with many “young black actors,” and soon started picketing theaters on Broadway for better job opportunities. Similarly, fellow Hoosier actor William Walker, who portrayed Reverend Sykes in the film version of To Kill a Mockingbird, became a fierce civil rights advocate in Hollywood after being relegated to roles as a domestic servant because of his race. Walker worked with actor and future president Ronald Reagan to obtain more roles for African Americans.

Around 1963, Gordone became the chairman of the Committee for Employment of Negro Performers (CENP). Gordone claimed in 1962 and 1963 that television producers feared the withdrawal of corporate sponsorship if they “put Negroes in their shows” and that “discrimination took more forms in the entertainment field than in any other industry.”

Although the Civil Rights Movement had made extensive strides toward improving equality among the races, civil rights laws did not deter de facto segregation, or forms of segregation not “codified in law but practiced through unwritten custom.” In most of America, social norms excluded African Americans from decent schools, exclusive clubs, suburban housing divisions, and “all but the most menial jobs.”  Federal laws also did not address the various factors causing urban black poverty. As racial tension mounted throughout the United States, Gordone struggled to survive in New York City.  During the last half of the 1950s, out of work and broke, Gordone took a job as a waiter for Johnny Romero in the first African-American owned bar in Greenwich Village.  His experiences there inspired his play No Place to Be Somebody, which he began scripting in 1960.

During the next seven years writing his play, Gordone sporadically worked in the theater industry.  He was an original member of the cast for Jean Genet’s The Blacks: A Clown Show.  The playwright, a white man, intended the play for an all African-American cast and a white audience.  He states in his script that “One evening an actor asked me to write a play for an all-black cast.  But what exactly is a black?  First of all, what’s his color?”

In The Blacks: A Clown Show, African Americans wage war against the “white power structure,” and the oppressed evolve into the oppressor. Warner noted that Genet’s play put Gordone “in touch with his black anger.”  In 1969, Gordone claimed that his experience as part of the cast changed his life because the play dealt with problems about race, enabled him to confront the “hatred and fear I [Gordone] had inside me about being black,” and introduced a talented group of African-American actors to the entertainment media including James Earl Jones and Maya Angelou.

Gordone finished his own play, No Place to Be Somebody, in 1967. The plot of the play revolves around an African-American bar owner named Johnny Williams.  Other characters include a mixed-race actor, a black homosexual dancer, a Jewish strumpet, a black prostitute, an Irish hipster, an aging black hustler, a member of the Italian mafia, an influential white judge, and the judge’s idealistic daughter. Johnny Williams, is a tavern-owner, pimp and wannabe racketeer.  His foil, Gabriel, also an African-American, is an intellectual struggling to be accepted as a legitimate actor.

According to a New York Times reviewer, the characters are forced to try and survive in a society controlled by white standards.  Johnny Williams possesses a desire to become “somebody” in Italian-run organized crime; Gabriel fails in his attempts to be cast in African American roles because he is light-skinned. The characters’ actions in No Place to Be Somebody are influenced by racial and cultural pressures directed towards characters of opposing races.  According to Gordone, “It [the play] is the story of power, about somebody who is stifled who was born in a subculture and feels the only out is through the subculture.”  By the end of the play, most of the characters fail in obtaining their goals because they have all set their “ambitions in excess of their immediate limitations.”

Gordone originally offered the play to the Negro Ensemble Company (NEC); an acting group rooted in the Black Arts Movement. He claimed the co-founder, Robert Hooks, turned it down because the NEC did not allow white actors in their theater troupe. Gordone and Warner produced a “showcase version” of the play at the Sheridan Square Playhouse in 1967, but “the response wasn’t too good.”  Gordone and Warner lost all their money in the venture. But in 1969, the play was accepted for the “Other Stage Workshop,” in Joseph Papp’s Public Theater, at the New York Shakespeare Festival.

No Place to Be Somebody opened on May 4, 1969 to mixed reviews.  New York Times reviewer, Walter Kerr, compared Gordone’s work to Edward Albee’s masterpiece, Who’s Afraid of Virginia Woolf?  Other reviews called the play “engrossing,” “powerful,” and hailed it as one of the “unique” plays of 1969.  On the contrary, influential African-American critic, Clayton Riley, blasted the play’s poor production and directorial choices.  Riley also questioned Gordone’s “incomprehensible” dialogue, depiction of “self-hatred,” “contempt for Black people,” and his “desire to say too much.”  Yet, Riley did state that Gordone possessed “splendid talents.”  According to Gordone, Riley’s review “hurt Riley more than me [Gordone] … brother Clayton is uptight.  He can’t face it that The [white] Man is helping one of his brothers.”

After the play’s opening, No Place to Be Somebody quickly moved to the Anspacher Theater for an extended period of time and opened for a limited run on Broadway in the ANTA Theater. Exactly one year after the play opened at the Shakespeare Festival, May 4, 1970, Gordone won the Pulitzer Prize for Drama.  The play was the first off-Broadway winner, and Gordone became known as the first African-American playwright to win the award.  Yet he did not appreciate being categorized as a member of “black theater” or the Black Arts Movement, unlike Indianapolis poet Etheridge Knight.

According to a 1982 interview, Gordone’s views on race “alienated many blacks.” Gordone argued, in a 1970 New York Times editorial piece, that writers like LeRoi Jones (Amiri Baraka) should write about more than “how badly the black man is treated and how angry he is.”  Gordone believed such theater intensified the split amongst the races, and he questioned “Is black really ‘beautiful’?  Or is that beauty always hidden underneath the anger and resentment?”  According to Gordone, Jones’ writing was “egotistical, smug, angry (never violent), frightened, and damning of every white man in the world,” and Gordone took offense that Jones was “attempting to speak for all people of color in this country.”

According to Mance Williams, Gordone opposed the Black Arts Movement’s notion that the “Black Experience is a singular and unique phenomenon.”  Gordone believed that African-American culture was one part of the larger American Culture, reasoning that without the “white experience,” there cannot be a “black experience.” Williams states that Gordone believed the races were interrelated, and helped create the unique qualities that defined the “white” and “black” races. In a 1992 interview, Gordone said “We need to redefine multiculturalism.  There’s only one culture—the American culture, and we have many ethnic groups who contribute.”

One possible explanation for Gordone’s belief in multiculturalism is the fact that he claimed his ancestral makeup consisted of “part Indian, part French, part Irish, and part nigger,” and he jokingly called himself “a North American mestizo.” Williams claims the playwright deemed the “color problem” could only be resolved through cooperation between the races, and that is why Gordone shied away from any radical political movements that could further divide the races.  However, according to Gordone, his exclusion from the Black Arts Movement left him “Dazed, hurt, confused, and filled with self-pity.”

Gordone claimed his professional success put tremendous pressure on him. Winning the Pulitzer Prize made Gordone unhappy because he was acclaimed as a writer, rather than a director. According to Gordone, “every time you sit down at a typewriter, you’re writing a Pulitzer Prize. You’re always competing with yourself and you have to write something that’s as good or better.” In 1969, he began drinking heavily, hoping “get the muse out of the bottle” after the “long struggle.” During Gordone’s battle with alcoholism, he still worked in the theater industry.  He got involved with a group called Cell Block Theater, which used theater as therapy as part of an inmate rehabilitation program.

In 1981, Gordone met Susan Kouyomjian and in 1982 they founded The American Stage, an organization devoted to casting minorities into non-traditional roles, in Berkeley, California.  The American Stage productions included A Streetcar Named Desire with a Creole actor playing Stanley; Of Mice and Men with two Mexican-American actors playing George and Lenny; and The Night of the Iguana with an African American actor in the lead role of Shannon.  According to Gordone, he and Kouyomjian never overtly wanted to provide more opportunities for “black, Hispanic and Asian actors,” but Gordone said “it is now very much my thing.”  Their goal was to logically cast actors “so that you don’t insult the work’s integrity.”  Gordone believed “innovative casting enhances the plays,” and makes them so exciting that “it’s almost like you’re seeing them for the first time.”

In a 1988 interview, Gordone continued commenting about the portrayal of race in contemporary literature and theater.  Susan Harris Smith asked if theater critics viewed Gordone as “black first and a writer second?”  He replied “Yes” and commented the practice was “racist.”  He claimed he was a playwright trying to “write about all people . . . and to say I [Gordone] have a black point of view is putting me in a corner.” He believed African-American critics finally reached a “significant realization” about the theme of No Place to Be Somebody, that “if blacks walk willingly into the mainstream without scrutiny their identity will die or they will go mad.”

In 1987, Texas A&M University hired Gordone to teach in the English and Speech Communications Department. There, Gordone began embracing the American-western lifestyle or “cowboy culture.”  The playwright stated, “The West had always represented a welcoming place for those in search of a new life,” and he found a “spirit of newfound personal freedom” within the American West.  Gordone remained in Texas until his death on November 16, 1995.  Friends and family scattered his ashes in a “traditional cowboy ceremony, with a riderless horse” near Spring Creek Ranch, Texas.

History Unfolded Project Part 4: The Nuremberg Laws and a Hoosier “Advocate for the Doomed”

In this continuing project, we are examining world events through the eyes of the Hoosier newspaper reader.  Because many of these articles were reported through the Associated Press and United Press news services, what we are really seeing is not just what Hoosiers knew, but what the average American knew, about the events leading up to the Holocaust.

Over the next several months, we will be contributing newspaper articles to the United States Holocaust Memorial Museum‘s project titled History Unfolded: US Newspapers and the Holocaust.  Using digitized newspapers mainly accessible via Hoosier State Chronicles, we are looking at key events suggested for research by the museum to see what Hoosiers knew when. The overall goal of the project is to contribute to the scholarship on how American media reported and under-reported Nazi atrocities.  Anyone can submit their research; find out how at History Unfolded.

In past posts, we asked when Hoosiers knew about the opening of the Dachau concentration camp; the Nazi boycott of Jewish businesses and the removal of Jewish leaders from government posts; and the 1933 book burnings. For this post, Part 4, we will find out what Hoosiers in 1935 knew about the Nuremberg Race Laws. We will also introduce James G. McDonald, a brave and tireless Hoosier who worked to help the growing number of refugees from Germany and who tried to warn the world about imminent Nazi plans to annihilate the Jews.

In retrospect, it’s hard to understand how the world could possibly not know that the Nazis were planning a horrific “Final Solution” to their “Jewish problem.” The signs were everywhere and the Nazis were not quiet about their intentions, but most people could not have imagined the unprecedented mass murder that would become known as the Holocaust. However, the average Hoosier, like Americans everywhere, had access to more than enough clues in their daily newspaper. On August 9, 1935, the (Indianapolis) Jewish Post quoted this foreboding statement from Joseph Goebbels, director of the Nazi Propaganda Ministry:  “No foreign protest will prevent Germany from annihilating the Jew – the enemy of the German state. The next few weeks will show what we will do to the Jews.” The Post also reported that “Reichministers [Bernhard] Rust and [Karl Hermann] Frank added fuel to the flames with addresses at Essen and Cologne promising that the government will not compromise on its present racial policy and that no let-up can be expected until the Jew is completely eliminated from German life.”

While they did not hide their goal of eliminating the German Jews, Nazi leaders bristled at criticism from the Allied powers who they blamed for many of their problems after WWI. In the same speech in which he spoke of “annihilating the Jew,” Goebbels complained about the treatment of Germany in foreign press. Goebbels stated: “Whenever someone looks cross-eyed at a Jew on the Kurfuerstendamm [a popular street in Berlin], there is a hullabaloo from London to Peiping. But why does the foreign press insist on converging on Germany? Let it cease about the world and it will readily find topics of greater urgency.”

This theme of encouraging the world to mind its own business was often an effective one.  Before the horrors of the concentration camps came to light, some African American newspapers even agreed. After all, black Americans had reason to fear persecution and even lynching by their neighbors and couldn’t trust their own government to protect them. Prominent African American newspapers asked: how could the U.S. throw stones, when it systematically denied rights and opportunities to its citizens based on race?

On September 14, 1935, the Indianapolis Recorder printed a brief but telling article on this point. The Recorder quoted Julius Streicher, the publisher of an anti-Semitic, Nazi propaganda newspaper, reporting that Streicher “took occasion to advise the Southern States of the American Union to mend their own vicious ways before attempting to point a finger of scorn at the misdeeds of others.” The paper quoted Streicher regarding lynching in the South: “We do not kill Jews in Germany . . . we have other ways of punishing them.” The Recorder then responded to his comments saying that while the “ugly plight of Jews in Germany” should not be discounted, Streicher’s words “should be solid food for thought” for Americans. The Recorder concluded, “Yes, Americans should set about putting their own house in order before telling Germany what to do about her own affairs.” Despite Streicher’s claims, the Nazi party was already moving towards the systematic killing of Jews and the Nuremberg Laws would soon provide them the legal framework needed to intensify persecution by codifying racial antisemitism.

Antisemitism before the rise of the Third Reich can be generally described as discrimination against Jewish people for their religious views. Nazi ideology, however, refocused antisemitism by creating racial theories that defined Jewish people as a race separate from Aryan people. According to this ideology, Jews were now identified not as people subscribing to a particular religion, but as members of a race who could be identified through blood and genealogy.

Nazis had to use genealogy (that is determining whether a person had Jewish ancestors) to define a person as a Jew because there is no science behind identifying Jews racially. According to the United States Holocaust Memorial Museum (USHMM), “the Nazis had long sought a legal definition that identified Jews not by religious affiliation but according to racial antisemitism” because “Jews in Germany were not easy to identify by sight.” While some Jewish Germans continued traditional religious practices and wore distinctive clothing, most Jews in the 1930s looked the same as any other modern German man or woman. However, if they could codify this racial antisemitism by passing it into law, Nazis would have “the legal framework for the systematic persecution of Jews in Germany.”

This was Hitler’s goal in September 1935 when he called the Reichstag, or Nazi Parliament, to convene in Nuremberg in the midst of a Nazi party rally. Newspapers across Indiana announced the convening of the Reichstag, albeit without the illuminating quotes published by the Jewish Post. However, an AP article that ran September 13, 1935 in the (Columbus) Republic noted that the Reichstag’s meeting during the Nazi party rally meant that “the party and the state are identical.”

In other words, the Nazi party was now the German government. In a move that symbolized this solidification of party and government, Hitler prepared to declare the “nazi swastika flag . . . the one and only flag of the Third Reich” at the Reichstag meeting, according to an International News Service (INS) article published by the (Hammond) Times. The article continued to report that Hitler wished to demonstrate “the complete unity of the German state and the nazi party.” Thus, by the fall of 1935, there were no longer any government officials with the power to defend the rights of the Jewish people of Germany.

On September 15, 1935, Hitler announced the two laws, which together are known as the Nuremberg Race Laws: the Reich Citizenship Law and the Law for the Protection of German Blood and German Honor. According to the USHMM, the Reich Citizenship Law declared that only people of “German or kindred blood” were German citizens. The law also declared that “Jews were a race defined by birth and by blood,” not religion. Anyone, even Christians, with Jewish grandparents or parents was considered Jewish. The law declared that they were no longer German citizens and had no rights, but were instead “subjects of the state.” The Law for the Protection of German Blood and German Honor outlawed marriage and sexual relationships between “Aryan” Germans and Jewish Germans. Violating this law was condemned as “race defilement” and punishable with imprisonment or deportation to concentration camps. (Read the complete text of the laws through the USHMM here).

Indiana newspapers printed wire service articles on the announcement of the laws, but many missed their significance. For example, the Daily Clintonian (from Clinton, Indiana) ran a United Press (UP) article that focused on the promises of peace made by Hitler in his speech before the Reichstag. The article stated: “From the world standpoint his reference to peace was of paramount importance. It appeared to say plainly that Germany would not encourage Benito Mussolini’s ambitions and would adopt an attitude of neutrality similar to the United States.” However, in the same speech where he promised peace, Hitler threatened Lithuania. The article also naively interpreted the exclusion of Jews from German society as an opportunity for them, stating that “Germany’s new, drastic restrictive laws against the Jews will make it possible for them to have their own community life in Germany.” However, even this misguided article clearly printed the new laws, noting that Jews were no longer German citizens with rights but instead “state subjects.”

On the same day, the (Seymour) Tribune printed an Associated Press (AP) article that more accurately conveyed the significance of the Nuremburg Laws under the headline “Jews Placed in Medieval Status.” The newspaper reported on the specifics of the laws and that “Aryan citizens . . . will be separated sharply from ‘belongers to the state.’” Perhaps most foreboding, the article mentioned that Nazis hoped the rest of their ideology would become law in a similar manner. The article stated: “These acts inspired Der Fuhrer’s followers with the hope that the rest of the Nazi tenets would be translated into practical politics, step by step, just as fast as political expedience permitted.” To that end, the Reichstag gave Hermann Goring (the highest ranking Nazi official after Hitler) the power “to summon it into session at will” to create new laws. According to an AP article ran by the Kokomo Tribune also on September 16, Hitler concluded his speech by threatening “to enact even more stringent laws if today’s legislation fails to solve the Jewish problem.”

For the most part, Indiana newspapers were quiet in the days following the announcement of the Nuremburg Laws. The Indianapolis Jewish post was not. On September 20, 1935, in an article for the Jewish Telegraphic Agency, writer and editor Boris Smolar criticized other newspapers for putting a positive spin on Hitler’s address to the Reichstag and for focusing on Hitler’s orders to Nazi officials prohibiting “individual acts of terrorism against Jews” as opposed to the real message of the address: Jews had lost even basic rights. Smolar’s criticism could be directly applied to the aforementioned UP article in the Daily Clintonian which posited that Jews would be able to have their own community now that they were officially separated from the rest of Germany. However, while Hitler was promising protection for Jews, the Nazis were in reality relentlessly persecuting them. Smolar wrote:

The press generally hails the new laws relegating the Jews back to the medieval ghetto and warns the Jews not to make the necessary revision threatened by Hitler in his address to the Reichstag. Newspapers point out that these laws give the Jews official protection . . . Meanwhile, reports indicate that the campaign to deprive the Jews of food is going ahead apace . . . In other fields too, the campaign to segregate the Jews goes on relentlessly.

Smolar’s greatest fear however was that “the Jews will be held as hostages” if foreign countries including the United States continued their economic boycott.

In the same issue, the Jewish Post reprinted an editorial from the Indianapolis News bluntly stating that Hitler’s address to the Reichstag cleared up many misconceptions that might remain about separation between Germany and the Nazi party or any thoughts that Hitler would tone down the anti-Semitism or become more moderate once his power was established. The News stated:

Such doubt as recently existed as to whether the Nazi swastika was to be regarded as the German national emblem has been removed by the Reichstag’s declaration Sunday that the Nazi swastika is to be the flag of the Reich and nation. Whatever doubt existed as to whether Adolf Hitler’s anti-Semitism was as great as in the earlier days of his rise to power was also removed. . . The speech of Hitler to the Reichstag, however, and the measures promptly adopted at his urgence, give little support to those who had hoped for moderation. By these new enactments citizenship is denied the Jews. . . These enactments and the fanatical declarations so often made by Hitler and repeated by him Sunday, attributing virtually all of Germany’s troubles to the machinations of a race singled out for opprobrium can hardly tend to create confidence in the prospective sanity of a government completely under his control.

Other Indiana newspapers seemed slow to grasp the significance of the Nuremberg laws or even report on the announcement. For example, the Hammond Times did not report on the laws until November 15, two months after their enactment. However, Indiana newspapers did continue to report on the growing threat of Hitler’s Reich and on the debate over whether the United States should participate in the 1936 Berlin Olympics. What very few Hoosiers or Indiana newspapers were talking about, however, was how to help the people seeking refuge from the oppressive Nazi regime.

Not everyone remained silent, however. Hoosier James G. McDonald worked for most of his life to awaken the world’s conscience to the plight of German Jews seeking aid and refuge. In meetings and in letters to foreign leaders, the League of Nations, high-ranking diplomats, leading businessmen, newspaper editors, and President Franklin Roosevelt, McDonald expressed his fears for how the Nazis were planning to solve the “Jewish problem” and pleaded the case of German refugees. Fortunately his letters and journals from this period (published by Indiana University and the USHMM as Advocate for the Doomed and Refugees and Rescue) can be combined with newspaper articles to help us understand the work of one brave Hoosier at this time of crisis.

James Grover McDonald grew up in Albany, Indiana, attended Indiana University and Harvard, and returned to IU to teach from 1914-1918. In 1919, he became chairman of the League of Free Nations Association which worked to encourage the United States to join the League of Nations. The League of Free Nations Association soon evolved into the Foreign Policy Association and McDonald remained at its head until October 1933 when he accepted the position of High Commissioner for Refugees for the League of Nations. He was given the almost impossible task or finding homes for refugees from Germany.

During regular trips to Germany and meetings with high ranking Nazi officials, McDonald gleaned enough to suspect that the Nazis might be planning a tragic solution to the “Jewish problem,” though he could not have predicted the extent of the coming horrors. In a trip to Berlin in 1933, McDonald had a surprising amount of access to leading Nazi officials and policy information through Hitler’s press secretary at the time, Ernst Hanfstaengl. On April 3, 1933, McDonald wrote in a letter to the Foreign Policy Administration (published in Advocate for the Doomed) about a disturbing conversation with Hanfstaengl on the Nazi boycott of Jewish businesses in retaliation for a foreign boycott of Nazi goods. McDonald wrote:

Eventually we reached the subject of the Jews, especially the decree just announced for Monday’s boycott. He defended it unqualifiedly, saying: “When I told Hitler of the agitation and boycott abroad, Hitler beat his fists and exclaimed, ‘Now we shall show them that we are not afraid of international Jewry. The Jews must be crushed. Their fellows abroad have played into our hands.’”

McDonald wrote that he tried to explain to Hanfstaengl that there was no international Jewish conspiracy, but that the Nazi then “launched into a terrifying account of Nazi plans.” McDonald’s letter continued to quote Hanfstaengl:

The boycott is only a beginning. It can be made to strangle all Jewish business. Slowly, implacable it can be extended with ruthless and unshakable discipline. Our plans go much further. During the [first world] war we had 1,500,000 prisoners. 60,000 Jews would be simple. Each Jew has his SA [storm trooper]. In a single night it could be finished.

Here McDonald added his own thoughts in response to Hanfstaengl’s diatribe. He wrote: “He did not explain, but I assume he meant nothing more than wholesale arrests and imprisonments.” At this point, anything more was unimaginable. Still, he was kept awake that night with an impending sense of doom. He concluded his letter by describing a late-night walk through the beautiful but troubled city:

I reached my hotel before midnight. But there could be no thought of going to bed. So I walked alone to the Unter den Lindedn (a boulevard) and the Tiergarten (a park)  – a beautiful night, spring-like, bright stars, many lovers in the park, a world seemingly at peace and yet these ghastly hatreds breeding such shocking plans for heartless oppression of a whole section of the people.

Any illusion that the Nazi’s were planning anything other than the literal destruction of the Jewish people would soon disappear. Only a month later McDonald responded to a reporter-friend’s question on what he thought would happen “if there were a Franco-Polish occupation of Germany” with the answer: “Of course, I don’t know, but my guess is that the first thing would be a wholesale slaughter of the Jews” (May 16, 1933 diary entry in Advocate for the Doomed). What had happened over the previous month to change McDonald’s outlook? On April 7, 1933 he wrote in his journal:

I was at the Chancellery at 12:30 to keep my appointment with Hitler.

McDonald asked Hitler directly about the Nazi party’s policies towards the German Jewish people and recorded Hitler’s response in his journal entry for that date. Hitler responded defensively, stating that they weren’t only attacking Jews, but also communists and socialists. Hitler said that unlike the United States, Germany had previously accepted such people and therefore “cannot be blamed if we now take measures against them.” Hitler continued, “Besides, as to the Jew, why should there be such a fuss when they are thrown out of places, when hundreds of thousands of Aryan Germans are on the streets? No, the world has no just ground for complaint.”

Later, when he returned to the United States, McDonald gave more details of this meeting to the prominent Rabbi Stephen Wise. McDonald told Wise of a chilling threat from Hitler. Hitler had stated: “I will do the thing that the rest of the world would like to do. It doesn’t know how to get rid of the Jews. I will show them” (Advocate for the Doomed, 48, fn 73).

Over the next several years, in his role as High Commissioner for Refugees, McDonald worked hard to alert the world of the impending catastrophe and find people willing to help the refugees. However, while the Commission was organized by the League of Nations and affiliated with it, the League provided no financial backing. He pleaded with international government leaders, religious and charitable institutions, and individuals for aid and funding. For example, On May 11, 1934, after visiting ten European and Eastern European countries and meeting with leaders encouraging them to accept refugees, McDonald told the London Jewish Chronicle:

I think we have made a beginning. There is a clearer recognition of the difficulties involved, and, at the same time, of the acute urgency of finding a solution promptly . . . If only the governments could be made to realize that the refugees would constitute advantages to the material, moral and spiritual wealth of their new homes, the task of securing the necessary permission for the refugees to stay in the older countries or to enter into the newer countries would be immeasurably easier.

McDonald’s public statements were more positive and encouraging than his private reflections and letters. By 1935, he was completely overwhelmed by the need to help the growing number of refugees, by the inadequate response by the United States and her allies, and by the worsening crisis in Germany as epitomized by the Nuremberg Laws. Since the laws went into effect in September, he had been disheartened by increasingly bleak accounts of what faced the German Jews. Speaking with prospective British financial investors in October about a possible reorganizing of the Committee and plans to secure more funding, he saw little hope. He wrote in his diary:

He [a British banker] confirmed stories I had heard from other directions about food and medical shortages, the probability of radical action in implementing the Nuremberg Laws, and the waiving of all favors on behalf of the front-line soldiers or their children. In short, he sees the situation as hopeless . . .

He was equally disheartened that private organizations, especially Jewish ones were not responding adequately in contributing to refugee aid campaigns. In a letter to New York Governor Herbert Lehman which the governor forwarded to President Roosevelt, McDonald wrote:

The Jewish communities, particularly in Great Britain and in the United States, must at last realize the truth, bitter and terrible though it is, which you and I and some of the rest of us have tried to drive home to them for more than two years – there can be no future for Jews in Germany.

The Nuremberg Laws were the last straw for McDonald. As a protest against the failure of the world to act on behalf of Jewish refugees, McDonald resigned his post as High Commissioner in a letter to the Secretary General of the League of Nations dated December 27, 1935. His lengthy letter of resignation ran in the New York Times on December 30, 1935 and was widely reprinted and commented on in the international press. (Read the entire letter.) In future posts here and at the Indiana Historical Bureau’s blog, Blogging Hoosier History, we will look closer at the important work McDonald dedicated himself to, but here we will end with an excerpt from his resignation letter in order to convey the significant turning point that was the Nuremberg Laws.

McDonald explained that since the laws had reclassified Jews as a separate race, along with the increasing intensity of their persecution, the critical problem was no longer placing Jewish refugees (as important as this still was to him) but instead intervening politically with the German state to stop the persecution. This was beyond the capabilities of an unfunded committee tenuously aligned with the League of Nations. It was time for the League and its member countries to confront Germany, peaceably but sternly “in the name of humanity and of the principles of the public law of Europe.” McDonald concluded his resignation letter thusly:

. . . I gave in my former office frequent and tangible proof of my concern that justice be done to the German people. But convinced as I am that desperate suffering in the countries adjacent to Germany, and an even more terrible human calamity with the German frontiers, are inevitable unless present tendencies in the Reich are checked or reversed, I cannot remain silent . . . When domestic policies threaten the demoralization and exile of hundreds of thousands of human beings, considerations of diplomatic correctness must yield to those of common humanity. I should be recreant if I did not call attention to the actual situation and plead that world opinion, acting through the League and its member States and other countries, move to avert the existing and impending tragedies.

Emmett Forest Branch: Short Term Governor, Long Term Proponent for the People

Emmett Forest Branch may have only completed part of a term as Governor of Indiana, but he worked continuously for the people of the state. He constantly urged them to have faith in the Republican policy of “expansion of the agencies of government necessary to meet the requirements of the population.” By this, he meant improving schools, roads, and care of the state’s wards. As lieutenant governor and governor, Branch advocated specifically for these reforms.

Born in Martinsville to Elliott Branch and Alice Parks in 1874, Branch attended Martinsville High School and graduated from Indiana University in 1896. Branch’s father possessed a unique sense of humor, naming his children Olive, Leafy, Emmett Forest, and Frank Oak, to create his own family “tree.” Branch inherited this humor, inserting jokes into stories he shared. One story in particular went the twentieth-century version of “viral,” and was printed in newspapers across the country. In this story, Branch recalled one of his walks while in cadet school. He came across a man in need of money. Sure that he did not have a cent on him, Branch told the man he could have any money found while turning his pockets inside out. A silver dollar fell out, and Branch returned to his room confused. He later found out that he had worn his roommate’s pants by mistake.

Upon graduating from IU, Branch returned home to Martinsville to practice law. However, when the Spanish-American War began in 1898, he put his career on hold to enlist. After the war, Branch was elected to three terms in the Indiana House of Representatives in 1903, 1905, and 1907. While serving as representative, Branch worked for reform via the shippers’ railway commission bill, opposing big corporations. He is quoted as saying:

The time is past when the people should be taxed to further the rich corporations because the latter are now in a condition to care for themselves.

He also introduced legislation to make automated voting machines mandatory in an attempt to solve the problem of vote-selling and vote-buying, abolishing election frauds and election contests. During his 1907 term, he served as Speaker of the House. As speaker, Branch supported temperance reform, especially the local county option bill, which allowed each county to choose whether they should be a dry county. After his speakership, Branch continued to practice law in Martinsville. Once the United States entered World War I in 1917, Branch again enlisted, serving as colonel in the 151st United States Infantry.

In 1921, Branch was sworn in as lieutenant governor under Governor Warren McCray. His first act as lieutenant governor was to end the practice of “omnibus bills” in the Indiana legislature. This practice was used to vote on several bills at once. Branch is quoted saying “It is what I would call ‘guessing them off.’ Gentlemen, guessing off law that is to be fastened upon the people of Indiana is not right.” He closed with another statement: “We should first take care of the unfortunates in the institutions and then put Indiana where she belongs in the educational world.” Later in 1924 while discussing taxes, Branch asserted that, “You cannot have better roads, better schools, better teachers and better care of the unfortunates unless you pay the price.” These two statements encapsulate the position that Branch took as a Republican lawmaker toward improvements in the state.

Two issues arose in the General Assembly during Branch’s time as lieutenant governor with much debate by the public and the assembly. In 1921 and 1923, a “Memorial Day” bill was introduced that sought to prohibit automobile races, baseball games, and other sports on Memorial Day when admission is charged. This bill would end the Indianapolis 500, an Indianapolis Memorial Day weekend tradition since 1911. The bill was not passed in 1921, but was returned to a vote in 1923, where it then passed. But Governor McCray vetoed the bill, stating that he had “a sacred regard for the traditions and the purpose of Memorial day” and that the bill was “class legislation and therefore unconstitutional.”

The second issue that arose was the repeal of the 1919 anti-German language laws, passed in part because of World War I. Representative Waldemar Eickhoff introduced the bill in an attempt to remove discrimination against the German language. The bill eventually passed, but not without a rider attached to it that prevented “the teaching of any foreign language, including Spanish, Latin, and French.” The discussion of this bill became so intense that Branch broke his gavel on the podium trying to restore order.

Scandal hit the governor’s office in April 1924, when McCray was convicted on charges of “using the mails in furtherance of a scheme to defraud [his creditors],” and resigned from office. Branch became Governor of Indiana on April 30, 1924 as soon as McCray’s resignation became official. He was the first alum of Indiana University to become governor. With the little time that he did have in office, Branch attempted to build upon McCray’s goals. But before he did this, he had to investigate the administration to ensure that McCray had not involved or compromised the government. He ensured that all departments under the control of McCray were investigated before proceeding as governor.

Branch was a firm believer that education was a principal foundation of the government and that Indiana’s education system needed more support from the citizens to improve this system. He believed that better education meant a better citizenry, and that spending more on education would ultimately improve Indiana as a state. Republicans at the time pushed for a “county unit of education,” which would create a county board of education responsible for tasks such as locating schools and appointing teachers. Through this system, supporters hoped that the school system would have a more uniform quality throughout the state and a fair tax rate in the county. True to his Republican ideals, Branch recommended that the county unit of education be implemented via the seventy-fourth general assembly in his speech on January 8, 1925, saying “I think it should be done for I believe it a step for better education and that is one essential we must not lost sight of in building up our government.”

In October 1924, Governor Branch called a statewide safety conference to see what could be done to lessen the number of people being killed at railroad grade crossings. He hoped that in doing so it would save lives. Branch ensured that all delegates at the conference represented all interests in the subject—railroads, automobile clubs, etc. In his message to the Indiana General Assembly in 1925, he reported the solutions found by the conference members. Branch suggested creating a department of safety. The public service commission should be given the “power to require railroad companies to install and operate flash-light signals, signs, or other modern signal devices at railroad crossings over highways in the country.” Other suggestions included enacting a safety zone and a “Stop, Look, Listen” law to be enacted. Along with this, he was actively involved in extending the state highway system, believing, like many Republicans, that improved transportation would improve the economy.

Further advocating for the “unfortunates,” Branch’s first official statement as governor urged people to observe May Day as “Child Health Day” for the improvement of the health and happiness of children. He further supported healthcare for children by dedicating the new Riley Hospital for Children on October 7, 1924, the birthday of James Whitcomb Riley and namesake of the hospital. As lieutenant governor, Branch oversaw a law passed providing for the establishment of the hospital. In a letter to Hugh M. Landon, president of the Riley Memorial Association, Branch wrote, “I earnestly recommend that the citizens observe the week of October 1 to 7 as ‘Riley Hospital Week’ and make such plans to further aid this institution as their voluntary judgement and good faith in childhood may justify.” In January 1925, Branch boasted to the Indiana General Assembly that “the work being done there for the unfortunate little folks is of the highest quality.”

Support of children’s health was not his only concern—he also continued McCray’s efforts for a new state reformatory at Pendleton and relocation of the Indiana School for the Blind. He defended both of these decisions in his speech at the Republican Convention in May 1924. He encapsulated the speech in a pamphlet titled “The Truth About Your State Government,” in which he discussed the purchasing power of the currency and what taxes pay for in the state. He asserted that the Republicans took over the reins of government from “the most incompetent, inefficient and costly” Democrats in Washington and had been working to reverse the problems they caused. While this seems rather blunt, Branch explained how money was being spent and where in terms that non-politicians could understand. He ended his pamphlet on a good note by stating why he has faith in the people and in his party.

Unlike his predecessor, the most scandalous thing that Branch dealt with was the Indiana Bell Telephone Company’s attempt to force higher rates on customers without the approval of the public service commission. Branch “demonstrated his willingness to ‘go to battle’ for the rights of the people,” gaining more support as governor from the citizens of Indiana. During a speech before the Indiana Republican Editorial Association, Branch asserted that “as long as he was Governor the Governor’s office and all other state departments would be found fighting for the interests of the people ‘against this monopoly.’” In 1925, this issue gained the majority of attention in discussing the high points of his term.

A fan of Abraham Lincoln and proud Republican, he often reminded people that the former president once contended “The Republican party is good enough for me” and that “What was good enough for Lincoln is good enough for me.” In an article published upon his death, Branch is described as “austere and dignified, with a Lincolnesque face,” a description he would have loved.

After leaving office, Branch retired with his wife, Katherine Bain Branch, to their home of more than twenty years at 510 E. Washington Street in Martinsville. He practiced law and continued to serve as president of the Branch Grain and Seed Company. Branch died unexpectedly on February 23, 1932 at the age of 57 in Martinsville.

Justice for a G-Man: The FBI in College Corner

In August 1935, Special Agents Nelson B. Klein and Donald C. McGovern from the Cincinnati office of the FBI began investigating convicted criminal George W. Barrett, the “Diamond King,” for his suspected involvement in a number of motor vehicle scams in Ohio and elsewhere across the country. The Department of Justice had Barrett under surveillance since 1931 for dealing in stolen automobiles. In “Barrett v. United States,” in the Seventh Circuit Court of Appeals, heard on March 17, 1936, the court provided details on Barrett’s criminal activities, stating:

His method was to buy an automobile, obtain title papers for it, steal an automobile of similar description, change its motor numbers to correspond with those on the purchased car, obtain duplicate title papers, and then sell the stolen car to some dealer.

In each instance, Barrett sold the stolen vehicles with papers purporting to show that the sales were legitimate.

Special Agents Klein and McGovern learned that Barrett was in Hamilton, Ohio after a recent car deal there with the Central Motor Company, but neither they nor the local police were able to question him before he left the area. Acting on a tip, the G-Men – a term used to describe government men, particularly the federal agents working under J. Edgar Hoover – suspected Barrett might travel to College Corner at the Ohio-Indiana border, where Barrett’s brother lived. They drove there on August 16, 1935 and spotted Barrett near the residence of his brother’s home, along with a vehicle matching the motor number of an automobile involved in one of Barrett’s recent schemes. Klein telephoned the sheriff’s office in Hamilton for assistance in arresting Barrett, and he and McGovern parked their car and waited. Before Sheriff John Schumacher and Deputy Charles Walke arrived, Barrett returned to his car with a package in which he had hidden a gun.

Barrett went to unlock his car door, but as Klein and McGovern started their vehicle and began to approach, he abruptly turned and started walking away. Fearful that he was trying to flee and would elude them again, Klein jumped out of the FBI vehicle and called out to him to stop. Barrett ignored the calls and continued walking down a nearby alley with Klein in pursuit.

Once back in the open, the “Diamond King” opened fire, striking Klein numerous times. Klein returned fire and succeeded in hitting Barrett in the legs, but the federal agent succumbed to his gunshot wounds and died at the scene.

In the days following, newspapers across the country reported on the gun battle that had ensued in College Corner. On August 18, 1935, just two days after the shooting, the Indianapolis Star reported that Barrett would stand trial in Indianapolis and would be taken there as soon as his wounds allowed. Although College Corner falls right along the Indiana-Ohio line, agents confirmed that Klein had fallen dead on the Indiana side. The Richmond Item reported: “the trial, to be held in the Indianapolis Federal Courtroom, will be the first murder trial ever conducted in the Southern Indiana District Court.”

Federal officers transferred Barrett from the Hamilton, Ohio hospital to the City Hospital in Indianapolis on August 21. On August 26, the [Hamilton] Journal News reported on the recovery of one of the automobiles Barrett reportedly stole and transported over state lines from San Diego to Hamilton. Barrett allegedly changed the motor and serial numbers of the car before selling it to a garage in Hamilton. Jurors wasted no time in indicting Barrett for the murder of Special Agent Klein and for violating the National Motor Vehicle Theft Act.

Passed in 1919, the National Motor Vehicle Theft Act – also known as the Dyer Act – helped supplement individual states’ efforts to combat automobile theft in the country. In the fall of 1919, newspapers reported that the practice of stealing automobiles was on the rise throughout the U.S., especially in some midwestern cities such as Detroit, Chicago, and St. Louis. The Indianapolis News claimed that over 22,000 automobiles were stolen in eighteen western and midwestern cities in 1918. Other articles put the number closer to 30,000. Congressman Leonidas C. Dyer of Missouri, who introduced the legislation, argued that the losses amounted to hundreds of thousands of dollars each year, while also causing hefty increases in automobile theft insurance.

The act sought “to punish the transportation of stolen motor vehicles in interstate or foreign commerce.” In accordance with the law, anyone who knowingly transported or caused to be transported a stolen motor vehicle in interstate or foreign commerce could be fined up to $5,000, imprisoned for up to five years, or both. Those found guilty of violating the law could also be punished in any district through which the guilty party transported the vehicle. According to former Special Agent William Plunkett in The G-Man and the Diamond King:

The BOI (later the FBI) gained more influence in 1919 with the passage of the Dyer Act . . . now it could prosecute criminals who’d previously evaded the Bureau by driving across a state line. More than any other law, the Dyer Act sealed the FBI’s reputation as a national investigative crime-fighting organization.

Federal officers arrested many professional automobile thieves in the 1920s and 1930s after the law went into effect. In many instances, these criminals were wanted for other offenses, including murder. Prior to the passage of the act, federal agents did not have the authority to pursue such criminals and had to let local and state authorities try to handle the rising number of cases. In some instances, local authorities caught and successfully imprisoned criminals and gangsters of the period, only to see their prison sentences expire or have them escape and commit more dangerous crimes. This was particularly true in the case of notorious gangster John Dillinger. In the early 1930s, Dillinger and his gang robbed several banks, plundered police arsenals, killed a police detective in Chicago, and fled the county jail in Crown Point, Indiana in March 1934 after being held to await trial. The FBI’s website states:

It was then that Dillinger made the mistake that would cost him his life. He stole the sheriff’s car and drove across the Indiana-Illinois line, heading for Chicago. By doing that, he violated the National Motor Vehicle Theft Act, which made it a federal offense to transport a stolen motor vehicle across a state line.

After Dillinger violated the National Motor Vehicle Theft Act, the FBI became actively involved in his capture.

Both the National Motor Vehicle Theft Act and a recently passed 1934 law making the killing or assault of a United States officer a federal offense punishable by death sealed George Barrett’s fate. His trial began on December 2. According to The Tennessean, he was only the second man to be tried under the new law providing for capital punishment in the killing of a federal officer. Edward Rice, defense counsel for Barrett, argued that Barrett had been warned days before Special Agent Klein’s killing that Kentucky outlaws were after him and might pose as officers. As such, Barrett maintained that he acted in self-defense out of fear for his life. However, during his time on the witness stand, Special Agent Donald McGovern testified that Klein called out to Barrett and clearly identified himself and McGovern as federal officers.

On December 8, the Indianapolis Star reported that the jury only took fifty minutes to return with a guilty verdict. With no qualification calling for life imprisonment, Barrett was to be hanged. District Attorney Val Nolan stated “I think this is the greatest victory for law and order ever achieved in the state of Indiana.” Electrocution replaced hanging in Indiana several years earlier, but because Barrett’s sentence would be carried out under federal law, U.S. criminal code specified death by hanging.

On March 18, the Indianapolis News noted that George “Phil” Hanna, an expert hangman, would lead the execution. Known as the “Humane Hangman,” Hanna had participated in close to seventy previous hangings in an interest to see them done correctly, without additional pain or suffering to the condemned. Barrett hanged at 12:02 am on March 24, 1936 in the Marion County jail yard, and was pronounced dead ten minutes later. Despite the late hour, fifty people reportedly traveled to the jail yard to witness the hanging.

“Blacks Must Wage Two Wars:” The Freeman Field Uprising & WWII Desegregation

In 1945, at Freeman Field officers of the African American 477th Bombardment Group challenged the unlawful exclusion of blacks from officers’ club, resulting in their arrest. The uprising immediately gained the attention of the War Department, NAACP, and lawmakers such as Senator Arthur H. Vandenberg. The refusal of more than 100 black officer’s to comply with “Jim Crow” policies underlined the broader push for civil rights in the World War II era.

America’s involvement in WWII exposed the great disparity between the fight for freedom abroad and the treatment of African Americans at home. In 1945, The Pittsburgh Courier alleged that it was difficult to understand how President Harry S. Truman’s administration “can claim to be prosecuting a war to bring democracy to all of the world when it will not enforce its own orders supposedly establishing democracy in its own country.” Similarly, Hoosier businessman and Republican presidential nominee Wendell Willkie expressed concern with the treatment of African Americans in the Armed Forces. In his 1944 article “Citizens of Negro Blood” for Collier’s Magazine, Willkie stated that World War II “has made us conscious of the contradictions between our treatment of our Negro minority and the ideals for which we are fighting. The equitable treatment of racial minorities in America is basic to our chance for a just and lasting peace.” Roberta West Nicholson, Indiana state legislator and daughter-in-law of Hoosier author Meredith Nicholson, worked with the Indianapolis Servicemen’s Center during WWII and observed the same type of discrimination at Camp Atterbury. She successfully fought for black servicemen’s rights to utilize the exact same amenities and recreational facilities as their white counterparts, lamenting “It’s difficult to believe, but this is true; because the Army itself was segregated.”

Discrimination forced African Americans to fight to even be admitted to the Army Air Corps, which was an exclusively white organization until the late 1930s. According to James Allison’s “Mutiny at Freeman Field,” with the outbreak of global war, the Army revised its policy and recruited black units, but kept them segregated from white counterparts. The Air Corps sponsored flight schools for African Americans due to pressure from Congress and NAACP leaders, but accepted none of their graduates, despite exemplary records. Allison noted that “Countervailing pressures from politicians seeking the black vote and enterprising blacks who threatened to sue resulted in an Air Corps decision to form an African American fighter squadron” in 1941. The squadron, designated the “Tuskegee Airmen,” was trained at Alabama’s Tuskegee Field and produced a formidable combat record.

Unlike the Tuskegee squadron, the 477th Bombardment Group was trained at a base in Seymour, Indiana that included white servicemen. The group was first established at Selfridge Field near Detroit, under the command of white officer Colonel Robert W. Selway. The group was transferred to Kentucky’s Godman Field as the result of racial tension and protest similar to that which later occurred at Freeman Field. The 477th was then moved to the Freeman Field air base in March 1945 to train with better facilities. The Indianapolis Recorder noted in April that:

Arrival of the group here stimulated open hostility on the part of tradesmen in the nearby town of Seymour . . . Most of the trades people announced they would furnish no service or sell commodities to the new arrivals at Freeman Field. Negro residents of Seymour, less than 100 in number, are striving valiantly to meet the needs of the soldiers.

These men, many of whom were awarded the Distinguished Flying Cross and Purple Heart, encountered racial discrimination from white servicemen at Freeman Field. Little had changed regarding their treatment since WWI, during which African American entrepreneur Madam C.J. Walker and her sales agents wrote a letter to President Woodrow Wilson officially condemning the mistreatment of black troops. According to the Recorder, African American officers at Freeman were denied entry into the air base’s tennis courts, swimming pool, and “swanky” officer’s club after 5 p.m. by Officer Selway, who created a “superficial classification that prevented their enjoyment of facilities established for commissioned personnel.” This classification violated Army Regulation 210-10, which prohibited the racial segregation of officers at army camps. According to Allison, black officers mobilized to challenge the discriminatory action, meeting in hangars to plan a peaceful protest.

On April 5, 1945, Selway learned of the plan and ordered a provost marshal to guard the club and turn away black servicemen. At the end of the night, 61 officers were arrested for attempting to enter the club, three of whom faced a jury in July for “jostling a provost marshall [sic].” On the 7th and 8th, more officers were arrested for attempted entry of the club. In a move that could further institutionalize segregation, Selway pressured black officers to “sign a statement that attested to their understanding of the order that had established one club for trainees and the other for supervisory personnel” (Allison). Officers were read an Article of War threatening death for failure to obey command and then issued a direct order to sign. Undeterred, 101 officers refused to sign and were subsequently arrested and sent back to Godman Field. According to Historian Emma Lou Thornbrough, a commander of a local black American Legion Post asserted “Blacks must wage two wars-one against the Axis powers, the other for full citizenship at home.” The Freeman Field officers did just that.

First Lieutenant Quentin P. Smith was among those who refused to sign and recalled “‘I thought, ‘Oh my God this can’t be happening . . . He had given me a direct order to sign. I had finished college and all I had to do was just stay alive and I’ll be a general. I had no voice then'” (1992, Merrillville Times). After refusing to sign, he was escorted to his barracks at gunpoint and held under arrest for twelve days. In a document endorsed by Smith on April 25, he contended “The cited regulation appeared and still appears to be a ‘Jim Crow’ regulation” and that he:

could not, and cannot understand how Medical Officers, qualified as Flight Surgeons and having completed all required Army medical training and having completed years of private medical practice could have been classified as ‘trainee’ personnel unless the distinction were solely one of color.

He added he wished to indicate “his unshakeable belief that racial bias is Fascistic, un-American, and directly contrary to the ideas for which he is willing to fight and die.”

The Recorder reported that “The mass arrest which is believed unprecedented in the history of the Army has this post in an uproar and has disrupted the entire training program of the 477th Bombardment group.” By the 26th, it appeared that the uprising was beginning to influence Army policy, as the newspaper noted that “Officials of the Public Regulations Bureau of the department in Washington admitted momentous changes are being considered as result of an investigation of conditions surrounding” the incident. On April 28, The Pittsburgh Courier called for the immediate release and “return to duty” of the arrested men and that “Anything less will be a travesty on justice.”

Following public outcry and the efforts of the NAACP, all were released and served with an administrative reprimand, with the exception of three men. The Recorder noted on June 30, that Selway had been replaced with African American Colonel B.O. Davis Jr. However, the three men arrested for “jostling” an officer continued to be confined and were prohibited from obtaining counsel. In July, a jury acquitted Lt. Marsden A. Thompson and Lt. Shirley R. Clinton of “disobedience of a direct order,” along with Lt. Roger C. Terry, although he was found guilty of “jostling” an officer and forced to pay $150. In 1995, the Air Force set aside Terry’s conviction. In an Indianapolis Star article, Terry declared that this removed the weight he had been carrying since the ordeal and that “What came off my back was that all my hatred went away. All of it.”

Although their military records remained tarnished until the 1990s, non-violent protests, as well as the violence against returning black servicemen, likely influenced President Truman’s decision to desegregate the armed forces on July 26, 1948. In negating Terry’s conviction, former assistant secretary of the Air Force concluded that the Freeman mutiny was crucial to military integration and a “‘giant step for equality.'”
