The Indiana Historical Bureau is celebrating the fifty year anniversary of the passage of Title IX all week! Title IX, which was authored by Hoosier Senator Birch Bayh, provided that:
“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any educational program or activity receiving Federal financial assistance…”
As Title IX legislation worked its way through Congress, many questions arose – would this affect sororities and fraternities? Would colleges and universities be able to comply with the non-discriminatory laws while still turning a profit?
Many Hoosiers turned to their elected officials to voice their concerns in the lead up to the passage of Title IX and in the immediate aftermath. The Indiana State Library Rare Books and Manuscripts collection contains several of these letters in the Earl F. Landgrebe collection. In reading these letters, you can get a glimpse into the worries of average Americans and see how their elected officials addressed their concerns.
Two old wetlands, sometimes called bogs or sloughs, played a fascinating part in the capitol city’s history.
Fletcher’s Swamp is long gone but used to sit just east of the Old North Side, between Cottage Home and Martindale-Brightwood. A couple of hundred acres in size, the swamp occupied an area more or less centered around the future I-65/I-70 interchange. Pogue’s Run flowed just to the south.
To the boys of twenty-five years ago [circa 1864] this area was known as Fletcher’s swamp, and was a famous place for black and red haws, fox grapes and other wild fruits that only a youngster would think of eating. Fifty years ago [the 1830’s] this place was a verible [sic] dismal swamp, impenetrable even to the hunter except in the coldest winter, for it was a rare thing for the frost to penetrate the thick layer of moss and fallen leaves that covered the accumulated mass of centuries, and which was constantly warmed by the living springs beneath.
In the 1830s, Fletcher’s Swamp became one of the stops on the Underground Railroad. Calvin Fletcher, a Vermont-born lawyer and farmer whose 1,600-acre farm once included most of the Near East Side, was an active abolitionist during the days of the Fugitive Slave Act of 1850. For several decades, many Hoosier opponents of slavery, primarily Quakers, guided hundreds if not thousands of African American freedom seekers toward Westfield in neighboring Hamilton County. (Westfield was a major Quaker settlement before the Civil War, and other “stations” around Indianapolis focused on getting freedom seekers there.) Wetlands, usually hard to penetrate, were an ideal hideout, since the bloodhounds that bounty-hunters used to track freedom seekers lost their scent there. And like the counterfeiters on Bogus Island, refugees from slavery used retractable wooden “steps” across the swamp to help avoid detection.
Although not Quakers themselves, Fletcher and his family helped many African Americans travel north to Michigan and Canada.
Calvin Fletcher, Sr., became the owner of this swamp, or the greater part of it. Spring, summer, and autumn he was in the habit of riding horseback all around it. . . Mr. Fletcher delighted in the study of nature, especially in birds (and in the quiet of this swamp was bird life in sufficient variety for an Audubon or a Wilson), and he knew every flier and nest on its borders.
A tenant of a cabin near this swamp told the story that his attention was often attracted to Mr. Fletcher, for the reason that he rode out that way so early, and usually with a sack thrown over the horse’s neck. The curiosity of the dweller in the cabin was excited to that degree that, one morning, he furtively followed the solitary horseman. It was about sunrise, and he saw Mr. Fletcher hitch his nag to a sapling, take off the sack (which for some reason the narrator supposed to contain corn-bread and bacon), walk a little way into the covert, and then give a call, as if calling cattle. There was, in answer, a waving of elders, flags and swamp-grass, with an occasional plash in the water, and finally appeared the form of a tall, muscular negro, with shirt and breeches of coffee-sacking. He came silently out to the dry land, took the sack from the visitor’s hand, spoke a few words inaudible to the straining ears of the listener and hastily disappeared in the recesses of the swamps. So, after all, Mr. Fletcher’s favorite bird, and a very unpopular one in that day, too, was the blackbird.
The swamp might have had strange bedfellows during the Civil War. The dense thickets and morasses here were an ideal hideout for Confederate POW’s who escaped from the Union Army’s Camp Morton, which sat just west of here, near the future intersection of 19th Street and Central Avenue. Calvin Fletcher’s son, Stephen Keyes Fletcher, claimed in 1892 in the Indianapolis Journal: “During the war the swamp was this great hiding place for escaped prisoners from Camp Morton.”
What happened to Fletcher’s Swamp? Stephen Fletcher, who apparently inherited the property after Calvin’s death in 1866 — he ran a nursery nearby — told some of the story using terminology not employed today:
About this same time the negroes began flocking over from Kentucky and other Southern states. My father, being a great friend of the colored man, was inclined to provide them with homes and work as far as possible. After filling up everything in the shape of a house, I then let them build cabins at the edge of the swamp, on high ground, just north of the Belt railroad, and about where Baltimore Avenue now runs. I soon had quite a settlement, which was named by my brother, Dr. W.B. Fletcher, “Monkey Jungle,” and the location is known to this day  by that name by those familiar with it then.
The clearing of the swamp was an accident of President Lincoln’s emancipation proclamation. Hundreds of colored men, with their families, came from the South to this city. It was a class of labor new to Indianapolis, and for a time there was a disinclination to employ them. Mr. Fletcher, however, gave every man with a family the privilege of taking enough timber to build a cabin, and of having ground for a “truck patch,” besides paying so much a cord for wood delivered on the edge of the swamp. Quite a number of the negroes availed themselves of this offer of work and opportunity for shelter…
Calvin Fletcher, Jr., drained what was left of his father’s swamp in the 1870s by dredging it and connecting it to the “Old State Ditch.” Thus it shared the fate of thousands of acres of Hoosier wetlands sacrificed to agriculture and turned into conventional cropland.
An 1891 Journal article on the “State Ditch” calls Fletcher’s Swamp one of two “bayous” that threatened valuable property on the then-outskirts of Indianapolis.
Like its neighbor a little to the south, Bacon’s Swamp was created by the melting Wisconsin Glacier. About 20,000 years ago, the ice left an indent on the land that filled with water. As limnologists (freshwater scientists) describe, the process of swamp formation, lakes age and die like living creatures, filling up with sediment and plant matter and gradually losing the oxygen in their depths. Bacon’s Swamp evolved into a peat bog, one of the southernmost in the United States.
Like Fletcher’s Swamp, it took its name from a prominent local farmer active as a stationmaster on the Underground Railroad. A native of Williamstown, Massachusetts, Hiram Bacon moved to this remote spot with his wife Mary Blair in 1821. (Bacon was 21 years old, had studied law at Williams College, but due to poor health joined a government surveying expedition to the Midwest at age 19. He liked Indiana and stayed.) Presbyterians, the Bacons became friends with Henry Ward Beecher, brother of the novelist Harriet Beecher Stowe, when he served as minister of Second Presbyterian Church downtown. Beecher often came out to Bacon’s Swamp in the 1840s, when this was a remote part of Marion County.
Hiram and Mary Bacon actively helped freedom seekers escape through the area. A 1931 article in the Indianapolis Star claimed that “The Bacon house stands on the east side of the road [now the paved Keystone Avenue], and the large barn was on the west side. In it was a wheat bin, which could be entered only from outside by a ladder. It was usually concealed by piles of hay. Here and in the bin in the cider house, the fugitives were hidden and conveyed after dark to the next depot . . . The matter was never discussed in public.” At night, freedom seekers hid out in the peat bog across from the Bacon dairy farm.
Around 1900, this area, now considered part of Broad Ripple, was called Malott Park. Not to be confused with today’s Marott Park, Malott Park was a small railroad town later annexed by Indianapolis. Barely a century ago, it was one of the last stops on a railroad line that connected northern Marion County with the Circle downtown. Until World War II, Glendale was a far-flung place out in the country.
Walter C. Kiplinger, a chemistry teacher and tree doctor for Indianapolis public schools, wrote a fascinating article about the peat bog for the Indianapolis News in 1916.The part of the bog he described was about a mile north of the State Fairgrounds, near 50th Street and Arsenal Park. Now a major residential neighborhood, a hundred years ago it sounds like GPS coordinates were the only thing we’d recognize about the place:
You can reach it very easily if you have a machine [car] by taking the White River road to Malott Park, but when the spring rambling fever comes it is much more easy to go cross-country. It is just a pleasant afternoon’s hike there and back. . . If common courtesy is observed in closing gates and keeping off fields where the crops might be injured, the owners of the farm lands usually do not enforce their trespass notices. . .
How much peat there is in Bacon’s slough or how thick the bed is, no one seems to know. . . Whatever the average depth, it is as truly a peat bog as any in Ireland.
Serious proposals to harvest peat in Indianapolis were mentioned in the press from 1905 until the 1920’s, when the idea was apparently dropped. Other parts of Indiana, especially up north, also explored the possibility of using peat as a substitute for coal. During World War I, the U.S. and Canada exported sphagnum moss from North American peat bogs to Europe, where a cotton shortage had led army doctors to experiment with peat bandages on the Western Front. The moss served as a kind of natural antibiotic and was a success when used to dress wounds. (The story made it into the South Bend News-Times in 1918.)
Use of peat has always been widespread in Europe. Not a fossil fuel, it emits an odorless, smokeless heat and an “incredible ambiance.” For millennia, it has served as a cheap heat source in rural Ireland and Britain (where it also gives the “smoky” flavor to Scotch whisky.) The Indianapolis News ran an article about “inexhaustible” Irish peat in 1916, informing Hoosiers that “Mixed with crude molasses from sugar mills it is also used as a forage for cattle, while semi-successful efforts have been made to convert the vegetable fibers into a cheap grade of paper.” In 1929, a massive 40% of the Soviet Union’s energy came from peat, but today, large-scale industrial harvesting is only common in Ireland and Finland.
As an alternative fuel source, peat nearly became a reality in central Indiana in the early 1900s. E.H. Collins, a “scientific” farmer from Hamilton County, touted that the “earth that would burn” in the summer of 1905.
Collins owned a farm a mile north of the State Fairgrounds, in the vicinity of Bacon’s Swamp. An article on August 19 in the Indianapolis News refers to the 30-acre peat bog he “discovered” as the “Collins Bog.” The farmer estimated that it held about 400,000 tons of the fuzzy stuff.
The announcement that a good fuel deposit has been found at the city limits and can be drawn on in case Indianapolis gets into a fuel pinch is of great importance to a city that, thus far, has been left out of practically every fuel belt in Indiana in recent years — in fact, since she was the very center of the stove wood belt. Too far west to be in the gas belt, too far east to be in the coal fields and outside of the oil territory, Indianapolis, since the old cordwood days, has been a negative quantity in the state’s fuel supply. . .
The discovery of good peat deposits around Indianapolis calls attention to the fact that Indiana sooner or later is to come to the front as a peat-producing state.
Obviously, this never happened. Peat was briefly harvested in Bacon’s Swamp in the mid-20th century, as it was in a few other spots throughout northern Indiana, but the resource was mostly used for gardening, not as a rival to coal.
As Indianapolis’ economic downturn and “white flight” led to the explosion of Broad Ripple as a suburb in the 1950s, the swamp was more and more threatened. Conservationists were mostly ignored when they argued that the swamp protected creatures who keep insect populations in check and therefore help farmers and gardeners. In February 1956, three children drowned trying to save a puppy who had fallen through the ice in one of the lakes here, prompting residents in the area to push for “condemning” and obliterating the “deadly swamp.”
While the squishy, “bottomless” ground was a constant problem for developers — devouring roads in 1914 and 1937 — gradually only a tiny remnant pond was left, just west of Keystone Ave and a block south of Bishop Chatard High School. Yet the tree doctor Walter Kiplinger did remember one man who kept himself warm with a satisfying peat fire in Indianapolis back in the day.
His name was Michael O’Something-or-other, I’m not certain what, but he was a gentleman in the highest sense of the word. There was nothing hyphenated about his Americanism, but is a man any the worse American for having a bit of sentimental feeling for the old country in his makeup? Surely when one has a bit of Ireland’s own bog land in his own back yard, you might say, he has a perfect right to dig and use the peat for fuel. . .
Bacon’s Slough will probably go the way of similar places; but one should not be too pessimistic. The Irish may mobilize some St. Patrick’s Day, and go out and save it just for the sake of that peat bog. You can never tell.
(A website on pet health claims that “In the United States the poor Dachshund went from one of the ten most popular breeds in 1913 to being represented by 12 survivors in 1919.” A “lonely dachshund” showed up in Topeka, Kansas, that year in search of a home.)
Indiana’s 1919 anti-German law wasn’t the first of its kind. Parents and school boards had already been striking German classes from school curricula before the U.S. even entered the war. And devaluing the German language was a coast-to-coast phenomenon. Evanston, Illinois, banned the language in its schools in 1918. California kept up a ban on high-school German into the 1920s and in 1941 banned it in churches. At a speech on Long Island in 1917, Theodore Roosevelt urged Americans to rid the country of German, otherwise America risked becoming “a polyglot counting house for dollar chasers.”
A sign painter in Indianapolis who opposed Gothic lettering mentioned that Americans were already burning German textbooks. At Indianapolis’ Shortridge High School, a newspaperwoman connected to the Red Cross was applauded during a speech when she criticized the administration for not canceling German classes there. The German teachers switched to teaching Latin. Meanwhile, a new course on “contemporary war history” began and a hundred students enrolled. At a time when the U.S. was claiming to oppose German militarism, Shortridge considered its military history course to be the first ever offered at an American public high school.
Harding’s 1918 “Babel Proclamation” in Iowa did more than simply ban German instruction, though. The infamous law banned the speaking of all foreign languages in public, including Norwegian, Swedish, Dutch and Czech, which were still common in the Midwest. Fearing “spies,” Harding made having a foreign-language conversation on the telephone, on street corners, and in churches and schools a criminal offense. Iowa’s law was no empty threat. Violators were arrested and jailed.
The perception of German fondness for beer and liquor also earned the hostility of many Prohibition advocates, who had spent decades slowly “shutting off the tap.” A nationwide ban on booze was just around the corner, coming in January 1920. Yet as Chicago’s Lager Beer Riot back in 1855 proved, the history of Prohibition was closely tied to anti-labor attitudes. Squelching the German language was part of the process of extinguishing German sociability at a time when workers got together in pubs and beer gardens to talk about labor grievances and organize.
Although the language of the Indiana law would be more formal, State Senator Luke W. Duffey, speaking on the Senate floor, lashed out at the “stupid heads” of Germany and their sympathizers in America, who threatened to strangle education and spread disloyalty. Duffey finished off with a call for deporting traitors. He didn’t know it yet, but he was sounding the keynote of 1919:
The anti-German bill was about more than bigotry against German culture; it was also about stamping out the perception of political radicalism. Many people who supported the law had German last names, after all, like Speaker of the House Jesse E. Eschbach. Lieutenant Governor Bush read a letter at the Statehouse from “150 residents of Seymour of German extraction” who favored the language ban and asked why it was taking so long. The Germans of Seymour probably didn’t want to be associated with those deemed “subversives,” “traitors” and “terrorists.”
Urged by the Lieutenant Governor to enact “100 percent American” legislation, the Senate put the elementary-school bill up for a vote on February 17, 1919. Only one legislator, Senator Charles A. Hagerty of South Bend, voted against it. Yet even Hagerty’s opposition seems to have been against the political opportunism of the bill’s promoters rather than a real concern for education. On February 25, the House also passed the bill and Governor James P. Goodrich signed the legislation.
The South Bend News-Times, a liberal paper, thought the bill a classic case of legislative overreach, since most German-Americans were already trying hard to adopt English in their churches and schools. McCray had insisted that it would not interfere with the use of foreign languages in religious worship. (Many Lutheran churches still used German, and it was the main language of instruction at a few major Catholic seminaries.)
Ironically, the anti-German bills were overturned in 1923 by another man named McCray — Governor Warren T. McCray, who also butted heads with the Klan.
A few months after Governor Goodrich signed Indiana’s law, an anti-German bill passed through Pennsylvania’s legislature, also by a large margin. Pennsylvania Governor William C. Sproul, however, vetoed it. Sproul’s remarks to the press were probably the most intelligent words to come out of the whole debate. They are below and well worth reading in full:
Indiana’s anti-German bills were overturned in 1923 by another man named McCray — Governor Warren T. McCray, who is best remembered today for taking on another wave of intolerance in Indiana, the Ku Klux Klan. Despite their removal almost a century ago, Indiana’s anti-German laws serve as a powerful example of how extreme nationalism during wartime can lead to discriminatory government policy.
Hoosier State Chronicles has digitized over 8,000 issues of the Indiana Tribüne, once a major German-language newspaper. Published by The Gutenberg Company in Indianapolis, the Tribüne was silenced on June 1, 1918.
Marty Laubach was an unlikely political radical. Born in Indianapolis, Indiana, his working-class Republican parents attended a church with members of the ultraconservative John Birch Society. But several concurrent events placed him at odds with his parent’s conservative values. The 1968 riots at the Democratic National Convention, the possibility of conscription into Vietnam, the 1970 shooting of antiwar demonstrators at Kent State University by National Guardsmen, and his older brother’s antiwar views solidified his youthful rebellion. He began attending antiwar demonstrations and started working on an unauthorized publication at Arsenal Technical High School called After Breakfast. The publication, which had a short duration, ceased in 1971, so Laubach and a group of like-minded peers created a new underground newspaper called the Corn Cob Curtain. The paper’s countercultural tone and opposition to school policies about unauthorized publications on campus led students to file a lawsuit that went all the way up to the U.S. Supreme Court in 1974.
The Corn Cob Curtain controversy launched the conservative city of Indianapolis and high school students into a battle of free speech. Besides old newspaper clippings, there is no public recognition of the conflict. At its peak, the paper printed around 3,000 copies of a single issue, circulated in over 15 public and private Indianapolis high schools and the surrounding suburbs. It received criticism from school administrators, legal officials, concerned residents who submitted letters to the editors, and the city’s two major newspapers, the Indianapolis Star and the Indianapolis News.
Laubach and his peers were not alone in their efforts in challenging high school’s censorship policies. From mid-1960s to the mid-1970s, a minority of Indiana high school students published and distributed underground publications. Laced with creative drawings, designs, and witty language, they bared the names Blackhawk Broadcast, Desiderata, and the purposely-misspelled New Amerikan Mercury. Constituting a minority of contributors, these publications emerged in urban and rural areas and raised poignant questions about local issues, race, education, and free speech rights. Students remained either indifferent, hostile, or supportive. School administrators balked at their existence and contributors risked retaliation from school officials. Indiana State Treasurer, most notably, referred to them as “trash so foul as to be beyond normal belief” and claimed they were “flooding” high school and college campuses throughout the state.
One contributor, Jeff Jacobs, recalled his experience dealing with hostile school officials while trying to distribute the paper. Although he found Arsenal Tech and Crispus Attucks High School campuses welcoming, he faced resistance at Southport and Emmerich Manual High Schools. At Manual High, school officials threatened to call the Marion County sheriff. “These little skirmishes, with our oppressors should not discourage us, but should enlighten us to try that much harder,” he told readers. “One of the greatest reasons for the CCC’s exisstance [sic] is to equalize the student with the administrators.”
Within this atmosphere, the Corn Cob Curtain was born in 1971. Using pre-established social networks, activists met teenagers from other schools throughout the summer, forming a citywide underground newspaper. The witty name originated from two Cold War metaphors—the “Iron Curtain” and the “Bamboo Curtain”—that alluded to geopolitical divisions between communist and non-communist countries in Europe and Asia. Adapting these metaphors, the students argued that their fight for constitutional rights on campus grounds was akin to the ideological battle “between the Free world and the Communist world.” They found themselves “locked behind a kind of ‘curtain’ of Midwestern Provincialism—a curtain of corn cobs.”
The publication covered a multitude of topics. National and local news stories, American history, student affairs, education, music, movies, book reviews, and cartoons all appeared in the pages. Students critiqued their schools, with one contributor writing “All students in the Indianapolis area attending one of the prisons we call high school,” one written claimed. They insisted “high schools are de-humanizing,” and called for the formation of a citywide student union to “raise an effective voice to start the machinery in motions to bring about these changes.” But no such group ever formed.
Generating public support for the newspaper was an arduous task at first. Some students had reportedly claimed the paper “eats shit.” But these complaints had legitimacy. The first two issues were aesthetically unappealing, images were scarce, stories lacked headlines, and the publication was printed on mimeograph paper. The students improved the paper substantially by printing it on newspaper print, incorporating images, and overall, made it look like an actual newspaper. In the third issue, publishers wrote an article titled “On Your Ass” and lambasted students’ lackluster participation and demanded action on their part to improve the paper’s shortcomings. “You, your paper, need to criticize what’s wrong with the Cob, if you don’t like it. You are the only one who can change it,” they exclaimed. If anything, the students wanted their peers to know that the Corn Cob Curtain was a collective effort, not just the responsibility from a small group of volunteers.
The Corn Cob Curtain controversy began after the district Superintendent banned the publication upon the fifth issue’s release. Administrators’ justification for the ban stemmed from a cartoon that appeared on the back page. In a cartoon series called George the Cat, the character George wires up some dynamite in a bathroom while expressing dissatisfaction with the school. Just as he lights the fuse, the principal walks into the restroom, leading George to frantically jump into the toilet. As the principal begins using the restroom the toilet explodes. George survives the explosion with bruises, a broken arm, and human feces on his head. He quips, “I may have gotten rid of the school, but I’m still eatin’ the principals’ shit.” What was intended as a joke infuriated school officials who viewed the entire publication as obscene and wanted it discarded. The district’s attorneys agreed. They cited the cartoon as advocating “violence and the destruction and the school and the murder of the principal.” This gave school officials fodder to justify banning the paper.
Laubach and five friends sought legal assistance from Craig Pinkus of the American Civil Liberties Union of Indiana and Ronald Elberger of the Legal Service Organization (LSO). Both young lawyers, Pinkus and Elberger agreed to represent the students. As a publicly funded organization that represented low-income families in Marion County, the LSO received criticism for representing what the local press dismissed as privilege, middle-class youth. Although this description wasn’t entirely accurate, it never halted the conservative editorial board of the Indianapolis Star from alleging the group was seeking to “destroy the power of Indianapolis school officials to ban a smutty underground paper from high school.”
The federal district court ruled in the students’ favor, as did the U.S. Court of Appeals, citing that school officials had failed to show the detrimental effects the publication had on young people. Emboldened by calls to appeal the case by the Indianapolis Star and Indianapolis News after the district court ruling, the school district appealed the case all the way up to the U.S. Supreme Court in 1974. The oral arguments delivered by the school district’s attorney to Supreme Court justices revealed that school officials viewed the issue as a power struggle.
Attorney Lila Young insisted the district had “a complete inability to have any rules or regulations of what is going to be distrusted in our schools.” She constantly referred to the Corn Cob Curtain as “filth,” and alleged it contained “filthy cartoons” and “gutter language.” She argued that the distribution of such material contributed “to the delinquency of minors.” The students’ lawyer, Craig Pinkus, juxtaposed the publication to other material students read in schools that also continued inappropriate language, such as the New York Times, Wall Street Journal, and Catcher in the Rye. But the justices continuously asked him whether the policy applied to elementary schools, and Pinkus stated his organization drew a line between primary and secondary schools.
Since the students did not file a class-action lawsuit, Supreme Court justices ruled the case moot in February 1975. Additionally, the publication no longer existed, partly because the plaintiffs had graduated from high school. The court remanded the case back to the lower court. Justice William O. Douglass wrote a dissenting opinion about the mootness of the case. He believed clashes would continue between students and administrators and the issue might appear in court again. But his prophesy never came to fruition in Indianapolis. Interestingly, no consensus emerged for what the ruling meant. The ACLU argued that students’ rights to distribute an unauthorized publication on campus had not been overturned while the Indianapolis Star viewed the ruling as a victory for the school district, but acknowledged its inconclusiveness. Nonetheless, by 1975 high school underground newspapers were no longer a topic of contention in Indiana.
The Corn Cob Curtain controversy represented the clash of counterculture and conservative politics in a city impacted by the social upheaval of the 1960s much later than other major urban areas. Tame compared to locations such as the San Francisco Bay area, Chicago, and New York, it took little to be declared a radical by city and school officials in Indianapolis. Indianapolis’s high school students infrequently participated in strikes. Instead, they created a citywide student protest movement through an underground newspaper and built a growing, radical political consciousness in the process.

“Valpo” is a thriving university today, with some of the best programs in Indiana — and has no connections whatsoever to the KKK. Yet, a century ago, after its rapid rise to national fame, the highly-respected school experienced hard times that took many alumni and faculty by surprise.
Renowned for its economical tuition and low cost of living — as well as for admitting women and students from overseas — by 1905 “Old Valpo” enjoyed one of the highest enrollments of any private university in the U.S. With over 5,000 students that year, the school ranked just behind Harvard. Its affordability to working-class Americans led many to praise it as the aforementioned “Poor Man’s Harvard.”
Students from all over the U.S. and the world trained to be public school teachers there. Some were later busy teaching English to immigrants employed at Gary’s new steel mills. Valpo’s programs in law, engineering, medicine, and dentistry were well-regarded. Its College of Medicine and Surgery had been brought over from Northwestern University in Chicago. When the college moved back to the Windy City in 1926, it formed the nucleus of Loyola’s medical program.
Harvard and Yale might have been too good to take out ads in Chicago newspapers. But this ad from 1905 appeared next to one for another great school on the rise, the University of Notre Dame.
Yet, once enrollment peaked in 1907, venerable Valpo plunged into an unexpected, two-decade-long decline. After accreditation of American colleges and universities began at the turn of the century — partly driven by a desire to standardize high-school education and thereby “unify” the country — Valparaiso failed to win accreditation. Suddenly unable to transfer their credits, current and prospective students found the school a harder sell, especially as affordable new state universities, teachers’ colleges, and urban night schools entered the competition. Valpo’s lack of a football team and Greek life were another stumbling block, though it hurriedly scraped together a football program in the early 1920s and even played Harvard. (It lost 22-0 in its first game.)
World War I issued another blow. The famously affordable university had always attracted international students. (One of the more unusual of them was future Soviet Comintern agent Mikhail Borodin, “Stalin’s Man in China,” who would die in a Siberian gulag in 1951.) But after 1914, many of these students left to fight for their European homelands in WWI. When America entered the war against Germany in 1917, student military enlistment left Valpo’s academic and residence halls almost empty. Also, with plenty of war-related jobs now available to women, female students also tended to skip out on college for the duration of the war.
In 1919, Indiana passed a new law requiring private colleges to maintain a half-million dollar endowment. Cash-strapped Valparaiso University, burdened with a $350,000 debt (almost $5 million in today’s money) faced the real prospect of bankruptcy. The school’s trustees even tried to sell it to the state that year for use as a public teacher’s college, but the Indiana legislature declined the offer.
Holding on by a thread — and led by controversial president Daniel Russell Hodgdon, who turned out to hold fake medical degrees — desperate trustees and the equally-desperate citizens of Valparaiso sought new owners. That list of potential “saviors” grew to include the Presbyterian Church, the International Order of the Moose, and the owner of Cook Laboratories in Chicago, who wanted to turn the campus into a syringe factory and provide 1,000 jobs to townsfolk.
The efforts of the revived Klan proved more durable than that which had died out in the 1870s. Klan rallies and parades occurred all over the North and West, from Chicago and L.A. to Oregon and Maine. KKK membership in those years peaked in Indiana, Illinois, and Ohio, “ground zero” for some of the biggest Klan activity. D.C. Stephenson, the Grand Dragon of the Ku Klux Klan in 23 states, operated mostly out of his headquarters in Indianapolis, a city that was almost taken over by Klansmen and Klanswomen; It was also a city that fought a valiant battle in the press, courts, and churches to discredit the “Invisible Empire.”
The “second wave” of the Klan defined itself as a hyper-patriotic organization of white Protestant Americans and was more mainstream than at any other point in its history. Instead of waving the Confederate flag at rallies and parades as had previous iterations of the Klan, they flew the red, white, and blue. During the 1920s, the Klan was less concerned with suppressing African Americans than with stemming the tide of new immigration coming from Southern and Eastern Europe — including to heavily-industrial towns like Gary, just thirty miles from Valparaiso. The Klan sought to cripple an imaginary conspiracy contending that Catholics wanted to destroy American public schools and hand the U.S. government over to the Pope. It also warned of the activities of “Jewish Communists” and anarchists in the wake of the Russian Revolution and the 1919 Red Scare. Prohibition of alcohol, another cause taken up by the KKK, was a barely concealed way to crack down on immigrant culture.
These views were shared by thousands of Americans who didn’t belong to the Klan. The “Invisible Empire” even found strange bedfellows in the Progressive movement, including women’s suffrage advocates, who espoused some of the same “reform” ideals promoted by the Klan, albeit with different objectives. They also got involved in public health. In 1925, the organization helped fund a hospital in Logansport that catered only to Protestants. Alongside these initiatives, acquiring a university would have helped the Klan project a more legitimate image. Since Valparaiso was a teacher’s college, the Klan could also propagandize American children from within schools.
When encountering obvious concern from much of the faculty and student body, Elrod assured the press that a Ku Klux takeover of the school would change nothing except the trustee board, which was to be filled with Klan appointees. The school would remain open to women and would be non-sectarian, Elrod insisted — though Catholic students were already beginning to drop out and enroll elsewhere. Ludicrously, Elrod initially claimed that the Klan would admit any applicant who met the proper educational requirements, including African Americans, though he later admitted that the school would not have adequate facilities for them. (The sad irony is that Valparaiso University did not admit African Americans even before the Klan tried to buy it.)
Few people (trustees excepted, it seems) took Elrod at his word when he said that nothing else would change at the university, except skyrocketing enrollment and the return of its once prestigious reputation. Yet Elrod’s enemies had already come out. In the Fiery Cross on August 24, 1923, he was busy singling out “un-American” and “alien forces” as his opponents. Elrod may have been quick to pick up on campus rumors that Catholic priests from Notre Dame had visited town, spurring the Klan to act soon and not be outbid by the “agents of Rome.”
Heavy opposition came from the press. Even in Indiana, major urban newspapers tended to be anti-Klan, including the Indianapolis Star, Indianapolis News and most famously the Indianapolis Times, which won a Pulitzer for its battle against the group. Some of the sharpest criticism, however, came from George R. Dale, the wildly colorful and energetic editor of the Muncie Post Democrat. Dale, who endured death threats and assaults on his life and that of his family, ran a paper that was virtually one long, rambunctious op-ed piece, employing a folksy humor to give sucker-punches to the powerful “Indiana Realm.” Dale went on to become mayor of Muncie in 1930.
Editors and cartoonists nationwide– including E.H. Pomeroy, an illustrator for the Valparaiso Vidette — tore into Elrod’s proposal once it came out that he might, in fact, get hold of the $350,000 in cash needed to bail the school out of debt. (Elrod also promised that the Klan would set it up on a million-dollar endowment, twice the amount required by Indiana law.) As the story spread across the U.S., an illustrator in the New York Call went straight for the jugular, publishing a parody of Dante’s Inferno — “Abandon All Brains Ye Who Enter Here.” The cartoon depicts book-burning, classes in whipping and tar-and-feathering, a “Klinik” to teach “100% Americanism,” and a commencement day ceremony where students sport an unconventional new style of cap and gown.
Another critical broadside came from Helena, Montana. The writer in Helena’s Independent Record thought that a bout of education for those in the Klan might at least have a few “salutary” side-effects.
One editorial, “Ku Klux and Kolleges”, appeared in Robert W. Bingham’sLouisville Courier-Journal. It asks if there is no provision in the Indiana school’s original charter to prevent the sale to the Klan. The Courier-Journal also pointed out that many teachers in Kentucky had been trained at Valparaiso in its better days, and that Kentuckians should be concerned about its ultimate fate.
Though excitement among some Valparaiso citizens allegedly ran high, Milt Elrod was probably too quick to make blustery promises about the Klan’s own financial strength. His proposal to buy the school wasn’t completely baseless, but Elrod was a notorious booster and propagandist.
Through the sale of thousands of robes, newspaper subscriptions, and membership fees, the leadership of the Klan had amassed huge fortunes for itself. D.C. Stephenson had gone from being a poor coal dealer in Evansville to a wealthy man by age 33, but he squandered Klan money on liquor, women, cars, and a yacht. Even the $350,000 needed to buy the Valparaiso campus — not to mention the $1,000,000 offered as an endowment — was apparently beyond the ability of the Klan to come up with (or hang onto).
The American press and higher education breathed a sigh of relief when, after just a few weeks, Elrod feebly announced that the Klan had changed its mind due to “legal technicalities.” Some papers reported that — true to the Louisville Courier-Journal’s suggestion — a clause in the school’s original charter had been discovered, preventing control by any “fraternal, benevolent or charitable order” (an inaccurate description of the Klan, at any rate).
“Legal technicalities” caused by the school’s charter might have been a myth, a clever way for both the university and the Klan to save face after the embarrassing episode. Most newspapers ran with it, but there seems to be little evidence that university trustees would have called off the sale if enough cash had been put down in front of them.
In the summer of 1925, the Lutheran Church-Missouri Synod rescued the run-down, almost abandoned school. Lutherans at that time had several colleges and seminaries around the U.S., but no university. They announced vague plans to use it as a theology school or teachers’ college. Securing the deal was assisted by Reverend John C. Baur, a Lutheran minister and noted opponent of the Ku Klux Klan in Fort Wayne, Indiana.
Under Lutheran guidance, Valparaiso University’s fortunes gradually turned around, though it barely survived the Great Depression. By the 1950s, “Old Valpo” once again ranked among Indiana’s and the nation’s best colleges, a reputation it still holds today.
Legendary choreographer and “unsung gay hero” Charles Allen sat with a tape recorder in his Fort Wayne house, a veritable art museum awaiting curation. Sipping gin and orange juice from an empty peanut butter jar, he began to document his life. Notorious for self-mythologizing—once claiming to have killed a man using “voodoo and black magic”—some of the anecdotes he fed the tape no doubt were embellished. These would prove unnecessary, however, as his legacy speaks for itself. Not only did Allen give “birth to generations of dancers and . . . change the way people looked at the world around him,” but he inspired and empowered LGBTQ+ Hoosiers, perhaps unintentionally. Upon Allen’s 1980 death, Jerry Jokay wrote in TROIS, Fort Wayne’s gay newsletter, that “Although he probably wouldn’t have seen it this way, one of his greatest contributions was that he was a gay hero. And he is a gay hero simply because his gayness was a trivial issue in his life even in spite of the oppression it caused him.” Allen, on the other hand, would probably consider his greatest contributions to be advancing performing arts and instilling a love of storytelling and self-expression in Hoosiers.
Born in 1912, Allen was likely raised by his aunt and uncle in Mongo, Indiana. Depictions of Allen’s childhood are characteristically colorful and include a traipse through Tamarack Swamp with famed author and naturalist Gene Stratton Porter in search of insects and plant specimens. Allen “recalled dyeing his hair pinkish-brown as a child, catching blue racer snakes, putting them around his neck, and startling passersby on highway 20 near his home. A barefoot, innocent, wild-haired child of the swamp.” The spirited child attended school in Kendallville and spent free time in LaGrange, where he learned to play piano at Wigdon Theater. Fully enamored with artistic expression, he devoured performances delivered by a travelling company. The News-Sentinel reported “there was a troupe of four or five men, who did a two-reel silent movie, and set up an impromptu stage with an indian scene. There was singing, and two of the men did female impersonations. When he left the show, his life had changed. . . . He’d fallen in love.”
The production continued to call to him, long after the caravans departed. He left school, took a train to northern Michigan, where the travelling company had migrated, and became its new pianist. As despair deepened during the Great Depression, the public increasingly took solace in travelling shows. These provided Allen with opportunities to try his theatrical hand and hone his skills as a performer. The News-Sentinel noted, “People were doing almost anything for money. He fell in with a freak show,” dubbed the Palace of Wonders, for which he mesmerized crowds as the Human Pin Cushion. During this period, Allen learned how to perform the “half-man, half-woman” act, styling his feminine half after screen siren Marlene Dietrich. When he returned to Fort Wayne, he would perform this routine at local tavern, Henry’s, and played piano at bars like This Old House, Trolly Bar, and the Caboose. Allen insisted that friends stay at his house once the bars closed down for the night, hating solitude.
The eclectic career he had forged for himself was abruptly derailed by the conformist ethos of the 1940s. At a time of global upheaval, Americans held evermore sacrosanct heteronormativity. The News-Sentinel reported that during this “less enlightened age,” a judge sentenced Allen to six years in a Michigan City Prison after “an affair with a soldier led to a charge of sodomy.” Allen recalled in the Fort Wayne Free Press that the judge declared ironically “we’re going to send you where you’ll be happy; locked up with a lot of men!” This prediction proved correct, as he spent time with paramours in a makeshift room fashioned out of old pianos and curtains. On weekends, he played piano for the men waiting in line to watch a movie. While it played, a band mate would take his place at the piano, so that he could go hold hands with his companion. During his few years in prison, Allen made friends, assembled a band—for which he played the sousaphone—and learned how to dance.
The News-Sentinel noted that in prison Allen “kept following his insatible [sic] desire to learn. Where he could find no one else to teach him, he taught himself. The creativity could never let him rest. It would be that way to the end of his life.” This cultivation of self-expression paralleled the journey of African American poet, Etheridge Knight. While serving eight years at the Indiana State Prison in the 1960s, he discovered the restorative power of writing, culminating in his revolutionary Poems from Prison. Knight later stated that “Poetry and a few people in there trying to stay human saved me . . . I knew that I couldn’t just deaden all my feeling the way some people did.”
So, too, did music and dance sustain Allen during his incarceration. Upon release, he returned to Fort Wayne, opening the Charles Allen Dance Studio. According to the Journal-Gazette, he was the city’s only choreographer and, through his trips to New York and Chicago, “single-handedly” invigorated the city’s theater scene. Something of a cultural conduit, Allen traveled to Vera Cruz, Mexico to research indigenous dances. He studied dance at the University of Guatemala and the Palace of Fine Arts in Mexico, imbuing midwestern students with unique material and perspectives.
In life and work, Allen gravitated towards those on the fringes, perhaps identifying with their struggles or the stigmatization they endured. He reportedly taught exotic dancers how to improve their performances and played piano at “houses of ill repute.” In his TROIS article, Springer wrote that Allen played piano and felt a “kinship” with Black Americans because “like him, they were among the outsiders of society.” Though he was exacting and sometimes cruel, the News Sentinel reported that “he would work with beginners no one else had time for, work tirelessly because he felt a love of what he was doing.” Janice Dyson recalled this experience, after her mom “scrimped grocery money to help pay” for lessons for her and her sister, Bernice. She recalled that Allen “was a real taskmaster. . . . Bernice was intimidated by him and quit after about a year. I wasn’t afraid of him, but I learned pretty quickly that when he said practice or else, he meant it.” Perhaps he hoped to provoke the same grit he’d developed through surmounting the many hardships imposed by society.
While he worked with Fort Wayne performers, Allen reportedly knew the jazz greats, like Billie Holiday and Louis Armstrong, and one friend noted that “a lot of famous people used to come here and have him fix their acts. Polish the acts. Reblock them or rechoreograph them.'” Legend has it that one winter Allen sold his horse to pay the train fare to see Holiday perform in New York City. Due to a snow storm, he was the only person to show up at the theater. The usher relayed his presence to Holiday, who performed only for him, after which they went out for a drink. She reportedly drove him to the train station and ran alongside the cars, waving as the train departed. Allen was so moved by the experience that he wept while watching the train station scene in “The Lady Sings the Blues.”
Purdue University Fort Wayne (PUFW) recognized the ingenue’s talent, hiring Allen to teach courses like Stage Movement. He felt immense pride about being self-taught. A man who embodied resistance towards oppression and convention, his influence intersected fortuitously with the cultural revolution of the late 1960s and 1970s. Friends and colleagues seem to agree that he was not an activist in the traditional sense, but he always answered when called to provide insight about homosexuality or the burgeoning “homophile” movement. He recognized that, as one of few men in the area living openly, if he did not engage in public discourse that no one one would. When asked by WANE-TV to serve as one of five panelists about homosexuality Allen agreed, saying “‘I’m all right here, I don’t have any problems because I’m not scared. But a lot of people are scared; they’re scared they’ll get arrested.” He appealed to dozens of people to serve as panelists, but only two agreed. Those who declined feared that their parents would disown them or that they would lose their job, as had one of Allen’s friends who served in World War II. Others claimed the panel was unnecessary or worried that it would upset the “status quo,” which had provided a modicum of safety. To this reasoning, Allen said, “‘I thought if everything is so fine, why can’t they get on the air and say it’s fine. It’s because it isn’t fine.”
Allen spoke about homosexuality at PUFW campus teach-ins and college classes, and wrote editorials for the student paper, The Fort Wayne Free Press, under the pseudonym “Claude Hawk.” He wanted audiences to understand that sexuality was not a choice, noting that “My own doctor tells me that one gene or chromosome determines sexual preference—not butchness, effeminancy, athleticism, not militancy, but whom you want to go to bed with.” He added that this knowledge, while “comforting,” doesn’t help if you get fired or the “bartender breaks your glass after each drink, etc., etc.” His efforts shifted the perspectives of students like Linda Lamirand and Katharine Stout, who attended a teach-in with the “brave man” who “sat up there and told it like it is.” The authors were enlightened by Allen’s revelations that he knew he was gay at the age of four and that scientific studies suggested that biology dictated sexual preference.
In one Free Press editorial, Allen addressed those who had come to terms with their sexuality, but faced the question “where do you go?” to meet someone. Of the dilemma, he wrote:
You can’t find someone at an office party or at a neighborhood bar because someone would ‘find out’. So you experiment. You drink too much or get so horny that, without experience, you get your teeth bashed in saying something dumb to to the wrong person; or the right-wrong person who relieves you of your watch, wallet, and rings. Or sometimes you are picked up by a nicelooking, intelligent, young man with long hair and bare feet, who turns out to be fuzz and you are entrapped, fined, and-or jailed.
He advised readers to find a “gentle, gay” friend, who can help navigate the covert social world, or a relatively tolerant restaurant or bar. A “third salvation,” Allen noted, was to “know an art or theater crowd who don’t give a damn. Not about you, but about it.” The theater provided a world in which he did not have to explain himself or act as a local spokesperson for homosexuality. He wrote that the “freedom, acceptance, and love” afforded by the theater community created “a place to breathe in this pollution of brotherhood. Since one doesn’t have to hide, or lose his job in these fields, these are the more obvious” ones in which to work. In fact, Allen noted that living as a gay man paralleled life in the performing arts, writing:
“You are forced to think and live like a male and play the game so well that you are never uncovered. And this becomes an art, gives you a facility for understanding objectively what’s going on. It’s like a play, and while others are doing it naturally you’re listening for clues, and if well rehearsed, arrive at a happy ending.”
While TROIS writer Jerry Jokay considered Allen “Fort Wayne’s unsung gay hero,” he noted that “his fortitude laid in the fact that he didn’t dwell upon his difference . . . Allen was preoccupied with being so much more, as his best friends attest.” Preoccupied, he was. Allen informed Free Press readers about his life, writing in 1971 that “I ran my own school, taught at Purdue, played piano in bars, was connected with Ft. Wayne Civic Theater, Kenosha Little Theater, Theater Alanta, had choreographed a Broadway show, was a Japanese paper folder, an Arabian knot tier.” He had traveled the globe in search of inspiration and imbued new generations of performers with it. The News-Sentinel wrote that “he became unique, in a world of his own creation. His art became his life, his life his art.”
His life, his art. Perhaps it was his cancer diagnosis that inspired him to detail them on tape, stories that writer Dan Luzadder suggested “may have been plucked from the intensity of his nether world.” We don’t know what stories he told, as he ran out of time to complete the recordings,* but perhaps he described the demands of caring for his pet python or recited original sonnets, haikus, and Limericks, “both clean and questionable.” We can be certain that his life and art profoundly influenced those around him. This is evidenced by the obituaries written upon his death in 1980 at the age of 68. Luzadder wrote in the Fort Wayne News-Sentinel:
There was loneliness and insecurity. There were things that drove him. And there was tremendous courage to live through the times of his life, to aspire to art, to survive with nothing more than intelligence and faith in himself, to go hungry, to be alone, to see the world in its intolerance and still love it.
On March 21, hundreds of people from all walks of life—including actors, dancers, bartenders, city officials, and editors—stood shoulder-to-shoulder at the Performing Arts Center to pay their respects to the man “whose life had taught them the meaning of art.” His memorial served as a final standing ovation, with Civic Director Richard Casey reading from “Hamlet,” poets performing spoken word, and dancers delivering a finale performance of “Mr. Bojangles.”
Allen provides us with a window into the experiences of those who lived openly in Indiana prior to the liberating events of the 1980s and 1990s. Before a sense of community was fostered by the formation of groups like Fort Wayne Gay and Lesbian Organization (GLO), Pride Week celebrations, and the publication of gay newsletters, Allen drew upon a deep reservoir of self-assurance and creative impulse to fashion a fulfilling life. In his 1980 tribute, Steve Springer described Allen as “an individualist. Society had its standards of behavior and Allen had his own.” And although he had suffered because of these standards, Springer insisted that “Long after Anita Bryant and her hordes of intolerants are forgotten, the legend of Charles Allen will live on.”

Many companies choose a face for their brand and then build a mythology around it. For example, the Converted Rice Company marketed their new parboiled, vacuum-dried rice as the homey-sounding “Uncle Ben’s Rice.” The company used the racially charged nomenclature “uncle” and an image of a distinguished-looking African American man to imply that the product would be like a friendly servant for the housewife. The company has claimed at various times that “Uncle Ben” was a respected rice grower or a hotel maitre d’, but more likely he never existed — much like Mr. Clean, Sara Lee, or Mr. Goodwrench.
While there are plenty of questions surrounding his origin story, the man called “Dr. Scholl,” was not only the founder of one of the most famous companies in the world and the inventor of many of its products, but he was a master of the world of advertising — changing the business in innovative ways. Scholl may (or may not) have been a quack doctor, but he was a crackerjack businessman.
William Mathais Scholl was born on a farm in Kankakee, LaPorte County, Indiana in 1882.* According to the 1900 census, William spent his youth working as a laborer on his parents’ farm, along with many other siblings. Sometime around 1900, Scholl moved to Chicago and found a job as a salesman at the popular Ruppert’s Shoe Store on Madison Street. Here, he encountered a variety of foot problems faced by his customers and became interested in podiatry. That same year, secondary sources claim, he enrolled in medical school at Loyola University. This has been hotly debated.
Despite investigations beginning in the 1920s and continuing today, it is still unclear if Scholl graduated with a medical degree around 1904 as he claimed. The Scholl College of Podiatric Medicine in Chicago supports the Scholl Museum which is dedicated to memorializing his achievements and authoritatively refers to him as “Dr. William Mathias Scholl.” However, the records of the American Medical Association tell a different story. According to Robert McClory’s investigative piece for the Chicago Reader in 1994:
“Visit the recently opened Scholl Museum . . . and you’ll find the doctor and his achievements raised to almost mythic levels . . . But check through the old AMA records and you’ll read about a man whose credentials are ‘entirely irregular,’ whose methods smack ‘strongly of quackery,’ and whose products ‘cannot be recommended’.”
There are also questions about his state medical license, as well as a later degree he claimed from the Chicago Medical College, an institution described by the American Medical Association as “low grade.” The AMA described Scholl’s “whole record” as “entirely irregular.”
Dr. Scholl, or “Dr.” Scholl, built an empire which has made his name recognizable all over the world. Degree in hand or not, at the turn of the twentieth century, young Scholl was busy inventing various devices intended to alleviate foot pain. One such device was the “Foot-Eazer,” which was a hit with the Ruppert’s Shoe Store customers. Supposedly one customer offered him several thousand dollars to start his business. He declined the offer, but was inspired to start his own business.
In 1904, Scholl set up shop in a small office in a building at 283-285 E. Madison Street in Chicago – the first location of the Scholl Manufacturing Company. By the next year, he began innovating new advertising techniques. Scholl would purportedly travel to various shoe stores, ask for the manager, and take out a human foot skeleton and put it on the counter. He used the foot to show how complicated and delicate all of the tiny bones are that hold so much weight and take so much abuse. He would demonstrate how supportive and comfortable his products worked.
Whether or not his products worked, his strategy of marketing directly to the store manager did. In addition to charging for the construction of the product, he also charged for consultations and fittings. Business boomed and in 1907 he moved into five rooms in a building on Schiller Street which had been abandoned by Western Wheel Works, a bicycle company. Almost immediately, he purchased the building and expanded the factory until it took up the entire block. The building stands and is in use as the Cobbler Square apartment complex — a nod to it’s former use.
By 1908, Scholl was using advertisements in trade journals to continue marketing his products directly to shoe store owners and managers. His approach at this point was to set up a booth at various fairs and train these prospective clients on how to talk about the Foot-Eazer “from a scientific prospective.” The ad below addresses these shoe store managers with several lofty promises about the Foot-Eazer:
“It will pay you well to be an expert in correcting foot troubles. . . you can sell a pair to one customer out of every three. Your profit is a dollar a pair – if you have 3000 customers that’s a thousand dollars for you . . .You will understand the science of it the moment you see it . . . as I have been allowed sweeping patents on it no one else can make anything like it.”
Scholl explained to this clients that his product was backed by “science,” would make them rich, and he was the only one who could provide it.
By 1909 he was recruiting teams of salespeople to approach the store owners for him. He set up a correspondence course to teach them the anatomy of the foot and the “science” behind his products. The course was called “Practipedics” and was described as “The Science of Giving Foot Comfort and Correcting the Cause of Foot and Shoe Troubles Based on the Experience, Inventions and Methods of Dr. William M. Scholl.” The ads from this period show that he was marketing these classes and sales opportunities to both men and women, an interesting approach for a time when few women worked outside the home. The ad below shows a woman studying the Foot-Eazer and promises that “This Alone Should Pay Your Rent.”
From here, Scholl’s business expanded even more quickly. By the time the U.S. entered World War One, Scholl was marketing to three different audiences — managers and owners of shoe stores, retail customers, and potential sales recruits — all through extensive advertising. Hoosier State Chronicles has a wealth of examples of ads for Scholl’s products, for stores selling them, and even for the Practipedics course. Indiana shoe stores often advertised special days where Scholl’s salespeople, presented as medical experts in foot care, would be at the store for personal fittings. In a 1917 issue of the Indianapolis News, the New York Store advertised their latest shoe styles and noted that they carried “A Complete Line of Dr. Scholl’s Foot Comfort Appliances.” In 1920, the South Bend Shoe Company advertised in the South Bend News-Tribune: “Foot Expert Here . . . A specialist from Chicago loaned to this store by Dr. Wm. M. Scholl the recognized foot authority.” This “expert” was most likely trained via correspondence course or week-long class and almost certainly never met Scholl.
Sometimes all three of Scholl’s audiences were targeted in one message, such as in the advertisement below from the Indianapolis News. First, the ad promises foot comfort to the average reader and pedestrian and explains to them the product while emphasizing the availability of “medically” trained dealers. Second, it advertises Marott’s Shoe Shop on East Washington who’s owners will have to stock up on Scholl’s products and provide the “foot expert.” Finally, the ad explains to the shoe dealers and other potential Scholl’s salespeople how to register for the next Scholl’s training course in Indianapolis. Additionally, Marrott’s Shoe Shop was a “Dr. Scholl’s Foot Comfort Store” which was supposed to consistently staff such “trained” foot experts — not just for special events. In Marrott’s advertisement which ran below the Scholl’s advertisement, the store claims that “Dr Scholl’s Foot Appliances are handled exclusively in Indianapolis by Marott’s Shoe Shop.” However, a search of Hoosier State Chronicles shows several other Indianapolis stores schilling for Scholl — including the New York Store from the advertisement above.
Another Indiana “Dr. Scholl’s Foot Comfort Store” was the Lion Store in Hammond. They were one of many stores around the country to participate in Scholl’s marketing plan for “Foot Comfort Week.” They advertised their participation and “foot expert” in the Hammond Times on June 12, 1917. Even general clothing stores participated in the marketing scheme. On June 21, 1917, the E. C. Minas Company, which called itself “Hammond’s Greatest Department Store,” advertised “Foot Comfort Week” in the Hammond Times which the ad claimed was happening “throughout the continent.” They noted that their store carried “the complete line” of Scholl’s appliances and “experts at fitting them to individual needs.” Later ads for the week-long event had more outrageous marketing schemes such advertisements for “Prettiest Foot” contests. By the end of the war, Scholl’s company was established across the U.S, Europe, Egypt, and even Australia. He had also established a Podiatry College and written a text book. However, medical doctors working in the field were quick to criticize Scholl’s entangled business and medical operations and began to publicly question his qualifications. In 1923, the National Association of Chiropodists passed a resolution condemning Scholl’s work and banning him from advertising in their publications. Again, Robert McClory’s investigative article is the best source for more information on the controversy stirred up around Scholl’s standing in the medical community.
Scholl was not slowed down by the nay-saying in the least. He continued to invent, patent foot products, and open new stores around the world. According to McClory:
“In his lifetime Scholl would create more than 1,000 patented ointments, sprays, cushions, pads, supports, shields, springs and other mechanical and chemical gizmos for the feet. Eventually the Scholl empire would include more than 400 outlet stores and employ some 6,000 people worldwide.”
According to a short essay by Fred Cavinder in Forgotten Hoosiers (2009), during World War II, the Scholl plant in England made surgical and hospital equipment while the Chicago plant converted to the manufacture of military equipment. Cavinder writes, “As Word War II ended, Dr. Scholl invented the compact display fixture with the familiar blue and yellow colors.”
Scholl remained connected to the northwest region of Indiana throughout his life. He resided primarily in a single rented room at the downtown Chicago Illinois Athletic Club. However, later in life he purchased a home in Michigan City, Indiana, where he had moved his side business, Arno Adhesive Tapes. This company made all of the plaster and tape for the Dr. Scholl products. In the 1960s, Arno also expanded greatly and Scholl, now in his seventies, remained just as active in its management.
Scholl died in 1968 and is buried in Pine Lake Cemetery in La Porte Indiana. His family sold the Scholl’s brand to a large pharmaceutical company in 1979 and it remains successful to this day. So whether we remember him as “Dr.” or Dr. Scholl, he created an empire, changed an industry, and invented new ways to market and advertise. As John H. Holliday strolled through Indianapolis’s Hungarian Quarter, he observed windows caked with grime, street corners lined with rubbish, and the toothy grin of fences whose boards had been pried off and used for fuel. While reporting on the nearby “Kingan District,” Holliday watched plumes of smoke cling to the meat packing plant, for which the area was named. The philanthropist and businessman noted that in the district “boards take the place of window-panes, doors are without knobs and locks, large holes are in the floors, and the filthy walls are minus much of the plastering.” Houses swollen with residents threatened outbreaks of typhoid fever and tuberculosis.
Those unfortunate enough to live in these conditions were primarily men from Romania, Serbia, Macedonia, and Hungary who hoped to provide a better life for family still living in the “Old World.” Alarmed by what he witnessed, Holliday published his report “The Life of Our Foreign Population” around 1908. He hoped to raise awareness about the neighborhoods’ dilapidation, which, in his opinion, had been wrought by landlords’ rent gouging, the city’s failure to provide sanitation and plumbing, and immigrants’ inherent slovenliness (a common prejudice at the time). Holliday feared that disease and overcrowding in immigrant neighborhoods could spill into other Indianapolis communities. Perhaps a bigger threat to contain was the immigrants’ susceptibility to political radicalism, given the squalor in which they had been reduced to living. Holliday wrote, “If permitted to live in the present manner, they will be bad citizens.”
Motivated by a desire to both aid and control immigrants, a coalition of local businessmen-including Holliday-philanthropists, and city officials formed the Immigrant Aid Association in 1911. Later that year, the association established the Foreign House on 617 West Pearl Street, which provided newcomers with social services like child care and communal baths, but also worked to assimilate and “Americanize” them. The Foreign House reflected the dual purposes of immigrant settlements in this period: what historian Ruth Hutchinson Crocker called “a mixture of protection and coercion.”
The first week of April 1908 was one of discord for northern Indiana. Hundreds of immigrant laborers stormed the Lake County Superior Court, “crying for bread” after the closing of Calumet Region mills. In Hammond, armed immigrants drilled together, causing police to fear the emergence of a riot. In neighboring Indiana Harbor, masses of desperate immigrants, many living in destitution, thronged the streets in search of employment. Blood spilled in Syracuse, when Hungarian laborers stabbed Sandusky Portland Cement Co. employee Bert Cripe. Apparently this was retribution for local employers’ refusal to hire Romanians, Hungarians, and “other laborers of the same class.” The stabbing set off a sequence of street fights between immigrants and locals, and resulted in the bombing of a hotel where laborers stayed. The Indianapolis News reported that the explosion “wrecked a portion of the building, shattered many windows, and not only terrified the occupants, but also the citizens of the town and country.”
These alarming events made an impression on a nameless employee at Indianapolis’s Foreign House, who referenced the Indianapolis News article in the margin of a ledger three years after the foment. The employee seemed acutely aware of the potential for unrest if the basic needs of Indianapolis’s estimated 20,000 immigrants went unmet.
According to Crocker, by 1910, 80% of Indianapolis’s newcomers had originated from Romania, Serbia, and Macedonia. Many of those who had recently settled in the Hoosier capital had migrated from Detroit, Kentucky, and Chicago, in search of jobs. Many Americans viewed such immigrants with derision, believing, as Holliday did, that they “‘differ greatly in enterprise and intelligence from the average American citizen. They possess little pride in their personal appearance and live in dirt and squalor.'” The 1911 Dillingham Commission Reports, funded by Congress to justify restrictive immigration policies, was designed to validate these beliefs. Using various studies and eugenics reports, the commission “scientifically” concluded that Eastern and Southern Europeans were incapable of assimilating and thereby diluted American society.
Reflecting the Report’s conclusions, a 1911 South Bend Tribune piece noted urgently, “A big portion of the immigrants are undesirable—very undesirable. . . . Markthis. If we don’t begin to really exclude undesirable immigration, the Anglo-Saxon in this Government will be submerged.” Its author continued that these “undesirables” would “soon become voters. Men who need votes see to that.” The founders of Indianapolis’s Foreign House hoped to bring together various nationalities, as their isolation made them a “political and cultural menace.”
In fact, the House’s very foundations belied the American ideals of business philanthropy and civic volunteerism. Kingan & Co. essentially donated the settlement’s structure, the local community funded citizenship classes, and work was furnished partly through “personal subscriptions and the assistance of teachers who have volunteered their services.” The settlement house would be modeled after YMCAs, offering baths, “reading and smoking rooms,” a health clinic, and night classes in which patrons could learn English. Additionally, civics courses and an information bureau, where “all the dialects of the foreign population will be spoken,” helped immigrants understand American laws and navigate the citizenship process.
These classes were crucial, as ignorance about American customs resulted in many newcomers placing their money and trust in corner saloons, whose owners often mismanaged or pocketed the funds. Immigrant Aid Association officers hoped that “opportunities for grafting and theft among the gullible class of foreigners will be reduced when the settlement house is in working order.” An understanding of the English language and the legal system could also help challenge the stereotype that immigrants were criminals because most offenses were committed due to their “ignorance of the law.” Furthermore, the Star noted in 1914 that, according to those in charge, classes about American government “have given the students an increased earning capacity and have been of great benefit in fitting them for work in this country.”
Questions about their intellectual aptitude persisted, as noted by the Indianapolis Star‘s 1915 observation of immigrants in night school: “It is an interesting sight to watch the swarthy men bending over their books and making awkward attempts to follow the pronunciation of their teachers.” Despite such evaluations, it is clear than many immigrants were grateful for the quality of education afforded in America. As relayed by an interpreter and printed pejoratively in the Indianapolis Star, a young Macedonian man who had recently arrived to Indianapolis “says he thankful most for the education he is gettin’ in America. He wants to bring father and mother here to free country.”
While the Foreign House introduced men to American cultural and political norms through these courses, immigrant women were indoctrinated through home visits by Foreign House staff. Ellen Hanes, resident secretary of the organization, made 2,714 trips to women’s homes in 1913, “teaching the care of children and teaching domestic economy as practiced by American housewives.” Historian Ruth Hutchinson Crocker contended that such services:
were the medium for teaching ‘correct’ ideas about a variety of subjects, from the meaning of citizenship to the best way to cook potatoes; thus they always involved the abandonment by immigrant women of traditional ways of doing things.
In addition to providing instruction about American customs, the House offered a space for fellowship and recreation. Likely feeling isolated in their new country, immigrants could socialize there and enjoy musical programs, as well as literary clubs with fellow newcomers. They could don costumes from their homeland, often “rich and heavy with gold and embroidery,” and perform folk dances and native music. Conversely, much of the entertainment centered around American patriotism, like a program for George Washington’s birthday, in which men dressed like the first president and women the first lady. The Indianapolis Star noted, “Probably at no place in Indianapolis are holidays celebrated more earnestly.” Crocker contended that this blended programming “showed the settlement in the dual role of Americanizer and preserver of immigrant culture.”
Recreational opportunities also lowered the possibility that immigrants would become a societal “liability.” One man who dropped by the house said, “‘We used play poker and go saloon and dance when we come Indianapolis. . . but now we read home books in our library, read English, do athletes, play music and do like Americans.'”
America’s entry into World War I in 1917 intensified suspicion of immigrants and spurred questions about their loyalty. This hostility impacted foreign institutions like Indianapolis’s German-language paper, the Täglicher Telegraph und Tribüne, which, despite trying to present balanced war coverage, ceased publication by 1918. In the years following World War I, the Foreign House was “practically abandoned,” perhaps another victim of xenophobia surfacing from the war’s wake. The emerging nationalist impulse likely accounted for the organization’s name change. The Foreign House became the American Settlement House in 1923, when the organization merged with the Cosmopolitan Mission and moved to 511 Maryland Street (where the Indiana Convention Center now sits).
Post-war labor strikes, anarchists’ bombing of American leaders, and fears that Eastern European immigrants would replicate the 1917 Bolshevik Revolution increased suspicion of and reduced support for immigrants. It also helped inspire the 1924 Immigration Act, which set an annual immigrant quota of 150,000 and drastically curtailed admittance of people from “undesirable” countries. A sense of isolation must have intensified for Indianapolis’s immigrants, now deprived of the settlement house’s resources and contending with renewed nativism. That is until Mary Rigg, a young, idealistic social worker was put in command of the American Settlement House in 1923. While conducting research for her thesis about the settlement, Rigg developed an affinity and deep empathy for its visitors. She began to envision a robust image of their future. With the assistance of the House, immigrant neighborhoods blossomed with colorful flowerbeds, giggling children shimmied up gleaming jungle gyms, and neighbors shared the bounties of a communal garden.
The goal would not simply be to help newcomers find employment, obtain citizenship papers, or avoid disease, but to experience, as Rigg stated, “true neighborliness,” where they “could play the game of daily living together in peace and harmony.” Rigg would be chief architect of this idyllic vision, in which immigrants could taste the fruits of capitalism, while embracing their native customs, language, and dress. After all, she believed that living “in a country in which we have the privilege of climbing higher” applied to its immigrants and that it was the settlement’s responsibility to help them ascend its steps.

Residents at Smithwood Hall, a racially-integrated women’s dormitory at Indiana University, pelted objects from their windows on April 8, 1960. This did little to drive away the students who surrounded the building, singing segregation songs with lyrics like “Glory, glory Governor Faubus, the South shall rise again” and “Let’s all go to n****r haven.” Not until campus police arrived did the emboldened protesters finally disperse. The reason for their ire? The university had just elected its first African American student body president, Elkhart native Thomas I. Atkins. In fact, he was the first Black student to serve as president of a Big Ten school.
Protesters apparently targeted the dorm “commonly regarded as the key housing unit in campus elections” because residents voted narrowly in favor of Atkins, 388-372. As Thursday night crept into Friday morning, sisters at Alpha Phi discovered a burning cross—a signature of the Ku Klux Klan—on the white sorority’s lawn. It was rumored that some felt the sisters’ voting apathy resulted in Atkin’s victory. Under the cloak of darkness, approximately 400 students congregated at the center of campus, some waving Confederate flags and others shouting that “a bunch of beatniks” had engineered the victory. Before they could hang an effigy of Atkins, campus police broke up the protesters. The hate-filled demonstrations resumed Friday evening, when another fiery cross was found near housing for married students. Leo Downing, dean of students, noted wryly, “‘Our so-called ‘Klan element’ was really stymied in this election. . . . They either had to vote for Atkins, who is a Negro, or for [Mike] Dann, who is Jewish.'”
Atkins, described by the Indianapolis Recorder as a “mild-mannered honor student and speaker pro tem of the student senate,” responded graciously, stating he would ignore the protests as “‘not representing the Indiana University student body.'” The backlash he experienced would follow him throughout his prolific civil rights law career, but his time in Bloomington helped him learn how to withstand it.
No stranger to adversity, Atkins recalled that after contracting polio at the age of five, doctors told him he would need to use crutches his entire life. Three years later, he was walking unassisted and in 1982 told the Boston Globe “‘One thing [polio] did was convince me that nothing was impossible.'” Developing tenacity at a young age served him well when Elkhart’s elementary schools “accidentally” integrated after the Black school collapsed and the town could not afford to rebuild it. Fearing for his safety, the third grader lined his pockets with rocks the first days he attended the desegregated elementary school. As a teenager at Elkhart High School, he accomplished what he would at IU: being elected as the school’s first Black student body president.

The backlash at Indiana University failed to tamp Atkins’s ambitions and the following month, the Muncie Evening Press announced he was the school’s first student to receive the U.S. Experiment in International Living grant. This allowed him to temporarily live in Turkey, where he gained insights for his thesis, “The Role of the Military in Turkish Society.” The Senior, who stayed with an Istanbul family of three, returned home in October and concluded that Turks “cannot see how the United States can propose to lead the free world and still have racial prejudice at home.” The following month he was one of three IU students nominated for a Rhodes Scholarship, which would fund three years of study at England’s Oxford University. So esteemed was Atkins that he was selected as one of twelve Board of Aeons students to advise university president Herman B Wells. In one instance, President Wells called upon him to convince discriminatory Bloomington barbers to cut Black students’ hair. Wells and Atkins convened a meeting with the barbers and, through compromise, got the barbers to agree to cut students’ hair regardless of their race.
While setting himself up for professional success, Atkins made a significant and controversial decision in his personal life. Seven years before the landmark Loving v. Virginia case, in which the Supreme Court ended bans on interracial marriage, Atkins married white South Bend native Sharon Soash. Reportedly, the couple met playing with the Indiana all-state high school orchestra, and in college carpooled to the South Bend-Elkhart area from Bloomington during holiday breaks. Soash had served as Atkins’s student body campaign manger and recently graduated from IU with a history major.
So taboo was their romance, that just before the wedding one photographer staked out at Thomas’s mother’s house in an attempt to snap a picture of the couple; he was quickly rebuffed. While Soash’s father considered Atkins to be a gentleman, he tried to talk her out of the marriage. Unable to be dissuaded, they tied the knot in Cassopolis, Michigan because, according to the Boston Globe, interracial marriage was illegal in Indiana. The newlyweds planned to return to Bloomington and live in a married housing unit, where they no doubt experienced their share of harassment. Now with a spouse to consider, Atkins decided to withdraw from the Rhodes scholarship nomination process.
The South Bend Tribune reported that both Atkins planned to pursue careers in national diplomacy, a field undoubtedly in-demand during the early Cold War years. Thomas was well on his way to this goal after earning a Woodrow Wilson Fellowship, which enabled him to pursue graduate studies at Harvard University. While there, a Ford Foundation fellowship allowed him to train in Arabic and Middle Eastern studies and earn his Masters in 1963. In fact, the Indianapolis Star reported that Atkins earned an astonishing twelve educational fellowships, five of which were from Harvard. Despite his international ambitions, he ultimately chose to fight on the “homefront” while working towards his law degree at the Ivy League school.
That homefront was Boston, where Black parents’ charges of de facto segregation in its public school system had routinely fallen on deaf ears. Atkins turned up the volume as the local NAACP branch’s executive secretary. His knowledge of the law, appreciation of educational opportunities, and ability to withstand racially-charged backlash, made the 25-year-old an ideal advocate for the city’s Black youth. Atkins and other NAACP leaders organized a series of protests beginning in the spring of 1963, like the June 18 “Stay Out for Freedom.” In lieu of school, approximately 8,000 junior and high school students met at ten designated “Freedom Centers,” like St. Mark’s Social Center, where they discussed the Black liberation movement and learned about citizenship. The organizers’ goal was simple: get the Boston School Committee to admit that de facto segregation was present in the district. Atkins summarized “We have not asked the committee to sign away its soul in blood, but merely admit that such a condition exists.” However, the committee refused to concede this fact—and would continue to do so for years.
The assassination of Medgar Evers, a Black WWII veteran and Mississippi NAACP Field Secretary, just days prior to the “Stay Out for Freedom” event underlined the need to fight for racial equality. Atkins served as master of ceremonies at a June 26th memorial service for the slain activist at Parkman Bandstand. Over 15,000 Bostonians turned out to pay their respects and march against injustice. Recognizing that protest must be coupled with policy in order to be effective, Atkins and other leaders hosted a voter registration drive at the memorial service.
Adding to their tactical repertoire, on July 29 Atkins and other activists blocked School Committee members from entering committee headquarters, threatening to do so every day until members agree to meet with NAACP’s Education Committee. Picketers handed out pamphlets to passersby about the “deplorable conditions of the Roxbury schools” and marched carrying signs that read:
“Stop Jim Crow Teacher Assignments”
“Why No Negro Principals?”
“Would You be Patient?”
“Don’t Shoot Us in the Back”
The battle lines firmly drawn, Chairman of the School Committee Louise Day Hicks responded that “Parades, demonstrations and sit-ins may appeal to the exhibitions, but they will not help the Negro school child who everybody admits does need help.”
Fed up with being stonewalled, Atkins, on behalf of the NAACP, issued an ultimatum to the School Committee the following day, stating it had until August 2 to meet or face bigger demonstrations. Atkins wrote, “It is launched with utmost regret, for the Branch would by far prefer the relatively quiescent atmosphere of the bargaining table to the commotion and clamor surrounding a picket line.” In issuing the ultimatum, Atkins advised the School Committee to consider:
Whether they are willing to accept the moral responsibility for this demonstration and as to whether they are willing to accept the political responsibility of having another debit chalked up on an accounting sheet which already show many more debits than credits in the areas of civil rights.
When that meeting did take place, School Committee members refused to discuss segregation. The longer the dispute went on, the more entrenched both sides grew. Although critical city officials categorized the conflict as a battle of semantics, Atkins and other leaders refused to move the goal post: without addressing segregation’s existence, equality would be impossible. Local reformer Susan Batson explained that de facto “was the most evil kind” of segregation because “no one is responsible and some say it doesn’t exist.”
Surely, the historic March on Washington for Jobs and Freedom in August—at which Martin Luther King Jr. delivered his “I Have a Dream” speech—further empowered Boston leaders, who organized a “sleep-in” at School Committee headquarters. Such demonstrations drew the ire of committee member Joseph Lee, who called NAACP protesters “frauds, mountebanks, and charlatans.” Further, he contended:
they are clearly doing all in their power to obstruct the education of the Negro-American school child in Boston, so that they can perpetually pose as a potential Moses to lead the deprived pupil out of such imposed intellectual bondage–and at the same time pose as saviors to gull [sic?] a handsome living out of white dupers.
To these allegations, Atkins responded as he did to the IU demonstrations, with measured aplomb, stating, “I think it’s amusing.” He suggested that white residents and school committee members were shaken because “The Negro wasn’t proud of being a Negro before. Now he is. There isn’t a Negro Problem in Boston—there is a Boston problem.” But when it became clear that the committee would not recognize segregation, Atkins focused on leveraging the Black vote. If activists couldn’t get committee members to change their minds, they would change committee members.
That summer, Atkins arranged for mobile registration booths to sweep the city in preparation for the elections. Before an audience of 6,000, gathered at the dilapidated Sherwin School on September 23, he urged, “Don’t complain-vote!,” foreshadowing the pleas of President Obama in 2016. Atkins framed voting as a form of self-help; to not do so would allow the school system to continue to “insult” and “ignore us.” He reminded the crowd that “Abraham Lincoln didn’t free you! He issued a document that has been studiously ignored for 100 years!” While Black and white children played on the playground, their parents sang emancipation anthems like “We Shall Overcome.” The audience also participated in a moment of silence to honor of the victims of the Birmingham bombing that took place just days earlier, another somber reminder of the injustices Black Americans faced.
With all hands on deck, the NAACP branch set out to collect voters’ signatures, registering 600 new voters in the predominantly-Black Ward #12 by the time polls closed on November 2. This was double the number of new Ward 12 voters registered in 1959. Now all that was left to do was wait as the election results rolled in.
Despite all their picketing, press conferences, and political campaigning, Atkins and fellow activists were dealt a blow when voters reelected each of the School Committee members. In fact, chairman Louise Day Hicks received more votes than even the mayor. Bostonians all but confirmed they agreed with the policy of “separate but equal.” But Atkins’s ability to mobilize Black voters helped sow the seeds of enduring political activism. According to the NAACP, 80% of eligible voters in Black wards turned out to cast their ballots, a percentage staggeringly higher than the 58% turnout in Boston’s other wards.
Atkins’s campaign to desegregate the school district—an effort that would require years of agitation—served another purpose, the Boston Globe noted. The city no longer looked to the South for news of the “Negro revolution.” Chants of liberation resounded in Boston’s streets, and the Globereported civil rights is now “on the lips of cab drivers and politicians, housewives and factory workers.” The Globe added that the Civil Rights Movement is not an “accidental ripple of the national wave of protest. It is well-planned and seriously developed by a small, devoted band of persons,” Atkins, being one of them. He “has been instrumental in the carrying out of the vigorous, new approach” of the NAACP. The Boston transplant helped inspire a new militancy in the fight for Black liberation, which would culminate later in the decade with the Black Power Movement.
The 1963 electoral defeat hardly took the wind out of Atkins’s sails. He worked for educational and employment equality when elected Boston’s first Black city councilman in 1967. Richard Hatcher’s election in Gary, Indiana—making him one of the first Black mayors of a large US city—that same year spoke to incremental gains in political representation for African Americans. In the tumultuous year of 1969, Atkins earned his law degree and went on to become a nationally-renowned civil rights lawyer. He continued to work with the NAACP to fight for Boston’s Black students in the 1970s and 1980s, overseeing the safe implementation of busing as a means of integration. In trying to mitigate the harassment and violence directed at Black children bused to new schools, he perhaps recalled his own childhood fears of attending Elkhart’s newly-desegregated school.
An NAACP survey inquiring about the challenges South Boston High School students faced in the 1970s confirmed the inadequacy of the education they had received. Atkins recalled:
I was sitting in my office one night, and I reached into my briefcase and here were these forms. So I took them out, and I began sort of absently to read through them. As I read through one after another of these forms, what I saw was that these kids couldn’t spell. They could not write a simple declaratory sentence. And as I read these forms, none of which were grammatically correct or spelling proper, I just started to cry. It was impossible to explain the feeling of pain on the one hand, but on the other hand, I knew we were right.
Anguish spurred action and Atkins became what The Times, of Munster, Indiana, described as “one of the most active and successful civil rights lawyers in the nation.” He filed segregation suits against school systems in Hammond and Indianapolis, Indiana; Cleveland and Columbus, Ohio; Benton Harbor and Detroit, Michigan; and San Francisco. One activist noted “There’s no place where Tom Atkins wasn’t influential.” According to his son, this prolific work made him a target of death threats and ultimately he left his Roxbury home for the protection of his family. His son described Atkins “running chicken wire over windows to block Molotov cocktails and installing spigots throughout the seven-bedroom house to connect the hoses for fighting fires.”

In 1994, Atkins returned to his alma mater for the dedication of IU’s new Thomas I. Atkins Living/Learning Center. On a campus once pockmarked with fiery crosses, stood a residence hall that focused on “academic excellence and cultural awareness-specifically, the culture and history of African and African-Americans.” While social progress had been made since the 1960s, racial issues persisted. The dormitory hoped to change that by facilitating discussions among various races and improve how students related to one another. With the new center, the campus also hoped to attract more Black students, an issue Atkins addressed at his 1994 visit. He said “Leadership is not made of being the first follower. . . . IU needs to get out in front and I don’t think the university has done that sufficiently. I hope IU accepts the challenge to get it done.” After all, “without education, the door is locked” to American minorities.
In his 50s, doctors diagnosed Atkins with Lou Gehrig’s disease. He was determined to overcome it through grit and hard work, as he had when afflicted with polio, stating “I believe miracles are usually man-made.” As the disease progressed, the Boston Globe noted he “continued to assist on cases even after he needed his son to translate his slurred speech and a special computer arm to help him peck out sentences.” The indomitable Atkins succumbed to the disease in June 2008, just months before voters elected Barack Obama the nation’s first African American president. His historic election came on the heels of work done by fearless leaders like Atkins, who the Boston Globe described as a “humanist” with a “steely resolve.” His time in Elkhart and Bloomington helped cultivate this unique blend of empathy and empowerment, best summarized by one of Atkins’s favorite sayings: “Power is colorless. . . . It’s like water. You can drink it or you can drown in it.”

In the fall of 1902, a crime syndicate was uncovered in the city of Indianapolis – not a syndicate of gambling, booze, or other illicit activities. No, this was a gang of “ghouls,” or men who robbed graves and sold bodies to medical schools on the black market.
Practitioners of this trade have been called many things – grave robbers, body snatchers, resurrection men, ghouls. Regardless of what they go by, they have a long and dark history tied inextricably to the advancement of medical science. In the 14th century, a professor at the University of Bologna began teaching anatomy using dissection as a tool of instruction. Soon after, four students at the university committed the first documented case of body snatching. The need for corpses had outpaced the legal means of obtaining them, driving students to procure cadavers by unlawful means. The rest, as they say, is history.
As medical education advanced, the need for human specimens rose at a dramatic pace. For centuries, however, the supply was met mostly by legal means – largely, the remains of criminals condemned to death. However, in the 17th and 18th centuries a confluence of two factors – a reduction of executions and the proliferation of medical schools – created a massive shortage. One which would be filled by a barely underground network of so-called “Resurrection Men.”
While illegal, the practice of stealing corpses to sell to medical schools often went unprosecuted as it was perceived as being “for the greater good.” The dissection of cadavers – weather obtained legally or otherwise – has been used to train new physicians in anatomy, lending them an unprecedented level of understanding of the human body. This, along with the fact that most of the victims were poor or people of color also helped law enforcement turn a blind eye. However, as the practice continued and more prominent families were victimized by the traumatizing act, states began expanding the legal channels through which medical schools could procure specimens. These acts are referred to as anatomy laws.
Indiana’s first anatomy law was enacted in 1879, perhaps not-so-coincidentally a year after the grave of John Scott Harrison, son of former President William Henry Harrison and father of future President Benjamin Harrison, was robbed and his body discovered at the Ohio Medical College. The 1879 law provided that:
the body of any person who shall die in any state, city or county prison, or jail, or county asylum or infirmary, or public hospital, within this State, shall remain unclaimed. . .for twenty-four hours after death. . .may be used as a subject for anatomical dissection and scientific examination.
While the law was meant to provide a morally sound avenue for medical schools to obtain bodies for dissection, that avenue still took advantage of the poor and mentally ill as it was highly unlikely that any of the deceased were ever given the opportunity to consent to their remains being used in this way.
But even with this law in place, there were still sometimes shortages. The early 20th century was one of those times. In 1902, at least five institutions in Indianapolis needed a steady supply of corpses. As the winter semester of the 1902-03 school year approached, these institutions vied for the inadequate lawful supply and eventually turned to the black market to fill their needs.
Dominating the black market was Rufus Cantrell. Having been a driver, porter, clerk, and even an undertaker, in 1902, he added a new title: The King of Ghouls. He, along with approximately seven other men, ran one of the most successful body-snatching syndicates in the city. According to the September 30, 1902 issue of the Indianapolis Journal:
He did not use hooks in pulling out corpses, as was done years ago. He only used hooks when a corpse was fastened in a coffin. Instead of digging down at the head of the grave, as was the former custom, he adopted the plan of digging in the center. The covering of the box was then sawed through and the small lid on the coffin shoved back. No lights are used by the ghouls . . . except an occasional match, which is lighted down in the grave.
It was hard, grim, and dirty work, but it paid off. Cantrell reported that between July and September of 1902, he and each of his men had earned $420 from their nighttime exploits, nearly as much as the average American made in a whole year. But their profits wouldn’t last long.
At least three different Indianapolis residents received anonymous tips that the graves of their recently buried loved ones may be found empty. Upon further investigation, the families discovered that this was indeed the case, and, more horrifying still, they discovered the missing remains in the basement of the Central College of Physicians and Surgeons. Panic gripped the city as newspapers published these stories. Families began guarding the graves of their recently interred relatives. Citizens called for investigations. Detectives staked out cemeteries and medical schools, waiting for the Ghouls to show themselves.
However, a break came from an unexpected source. A pawnbroker by the name of Emil Mantel grew suspicious of a customer after loaning him $28 in return for four shotguns. Mantel contacted his attorney, Taylor Gronniger for advice on the situation. When Mantel gave the name of the suspicious customer as Rufus Cantrell, Gronniger connected the dots. He had heard rumors about Cantrell’s unsavory practices, and here Cantrell was, pawning off more shotguns than any one person would need – shotguns that could be used to scare off any unwanted observers intruding on illegal happenings – and just when the grave robbing business was too hot to continue. So, Gronniger relayed his hunch to Detectives Asch and Manning of the Indianapolis Police Department. By the end of the next day, the detectives had arrested Rufus Cantrell and six of his associates and extracted full, corroborating confessions from each man.
Cantrell, the leader of the “gang of ghouls,” gave his confession in excruciating detail, seemingly proud of his escapades. He and his assistants had plied their gruesome trade at Crown Hill Cemetery, the German Catholic graveyard, Mount Jackson Cemetery, Traders Point Cemetery, and the Old Anderson graveyard, as well as the cemetery at the Central Indiana hospital for the Insane, where, Cantrell confessed, he and his posse had emptied over 100 graves.
He went on to implicate Dr. Joseph Alexander of the Central College of Physicians and Surgeons as his principal buyer. However, while most medical men simply feigned ignorance of the source for the bodies they were buying, Cantrell described Alexander as playing a much more hands-on role in the operation. Not only did Alexander knowingly buy stolen bodies, he identified potential targets, accompanied Cantrell on scouting missions, and even joined the gang in their nightly expeditions. Alexander was arrested, but quickly posted bail.
As Cantrell’s confessions continued, more empty graves were unearthed. The various medical schools around the city were searched thoroughly, but the bodies were nowhere to be found. Detectives Asch and Manning received a tip that Dr. Alexander had commissioned twenty pine boxes from a local box-builder to be delivered to the Central College of Physicians and Surgeons just days after the arrests had been made. This seemed like just the break they were looking for – surely the boxes had to be connected to the missing bodies. However, upon further investigation, it was discovered that Central College was in the process of moving locations and the boxes had been commissioned for the mundane purpose of packing away delicate medical instruments.
In mid-October, just as a grand jury was called to make indictments in the case, the mystery of the missing bodies was solved, at least in part. On October 14, 1902, the Indianapolis Journal reported:
Amos Smith . . . on his way to work, yesterday morning about 6 o’clock, partially cleared up the mystery of the bodies recently spirited away from the medical colleges. He found two bodies tied in sacks in a dry goods box at the side of Hibben, Holloweg & Co.’s store . . . The same young man, in walking farther south noticed two more bodies at the rear door of the Central Medical College.
After being positively identified by family members, there was speculation that a competing medical college in the city had disposed of the bodies near the Central Medical College in an attempt to throw all suspicion on that institution while dissuading further investigation. While these grizzly details were being spread in newspapers throughout the city, the grand jury received its instructions and began hearing testimony in the case. By the end of the grand jury’s investigation, twenty-five indictments were handed down and allegations had been made against seventy-five different people who were all part of three additional body-snatching syndicates in the city. Among the indicted were Cantrell and his associates, Dr. Alexander, four physicians from other schools, cemetery workers who facilitated the robberies, and various low-ranking employees of medical schools who had played some small part in the operation.
After several delays, the first Ghoul Gang trial, that of Dr. Joseph Alexander, began in early February. Alexander’s defense attorney’s strategy seemed to be to cast as much doubt on the character of the star witness, Rufus Cantrell, as possible. First, they attempted to link him to the unsolved murder of a Chinese immigrant who had been killed a year earlier. When that didn’t stick, the defense brought into question the sanity of the King of the Ghouls by introducing evidence that Cantrell had been diagnosed with epilepsy, at that time a broad diagnosis encompassing several mental illnesses.
Multiple physicians were brought to testify on Cantrell’s mental health. Each in turn pronounced Cantrell “insane.” Cantrell and the state begged to differ. Upon cross examination, each doctor admitted to having ties, past or present, to the Central College of Physicians and Surgeons, the same college which employed Dr. Joseph Alexander. Coincidence? Perhaps.
Coincidence or not, the evidence presented by the defense seems to have been enough to sway at least some of the jurors. The February 16, 1903 issue of the Indianapolis Journal reported:
Dr. Joseph C. Alexander’s status in the community is unchanged. He is neither the convicted felon of the heinous crime of complicity with ghouls and neither is he wholly absolved from the accusations made against him by the state’s attorney. . . Yesterday morning at 10 o’clock, after deliberating since the same hour Friday morning, the jury reported through its foreman . . . that it had not arrived at a verdict and undoubtedly would be unable to do so, and it was discharged from further service.
The result of one of the most anticipated trials of the year resulted in a hung jury. While the state’s attorney promised a retrial, it never came to fruition. Cantrell, who had all along hoped that his cooperation would result in a lighter sentence, saw the writing on the wall and refused to testify in the retrial. With their star witness gone, the state had little evidence against the doctor – or any of the other four physicians originally indicted, who had maintained their innocence throughout and whose only accuser was the now silent Cantrell. The next big trial was that of the King Ghoul himself.
Taking a page from Dr. Alexander, Cantrell’s defense team entered a plea of insanity at the onset of the trial. The state, of course, used the testimony of Cantrell himself given in interviews with police as well as during the grand jury investigation. The question of the trial was not if Cantrell had robbed graves, but why? Was he a greedy criminal just trying to make a buck, or was he criminally insane?
To make the case for the latter, Cantrell’s own mother was put on the stand. Through her testimony, the defense told the jury:
that they proposed to show Cantrell to be insane . . . that while Cantrell lived in Gallatin, Tenn., from the age of one to fifteen years, he suffered from epilepsy; that when twelve years old he was thrown from a horse and his head was injured; that when he was ten or twelve years old he had a delusion that he was called by God to preach, and told his friends that he talked with God face to face; that while at work in the field he would kneel at the plow and pray and preach from a Biblical text; that he still suffers from delusions and in the jail has preached to prisoners; that when taunted by his friends in Tennessee over his inability to preach he would become profane and once assaulted a minister with his tongue when he refused to ordain him; that he has a violent temper and has attempted the lives of himself and others; that he delighted to call himself the “King of the Bryan campaign,” and had cards printed with the words, ‘Rufus Cantrell – the Democratic hero;’ that he suffered a sunstroke in Indianapolis, which incapacitated him for work in hot places, and that he succumbed to heat while employed in the Malleable iron works. All these things, Cantrell’s attorneys would prove.
It should be noted that traumatic brain injuries can affect the mental health of those who experience them – they can cause mood swings, agitation, combativeness, and other cognitive symptoms. And both epilepsy and sunstroke were used in the 19th century to describe various mental illnesses. That being said, it’s difficult to tell from newspaper reports alone how much the testimony given was exaggerated in an attempt to keep Cantrell out of jail. After all, he did deny having any mental illness during the trial of Dr. Alexander.
Yet another topic that may have played a part in the trial, and certainly played a part in the sensationalized coverage of the case, is race. Rufus Cantrell and his associates were all Black men. Alexander and the other physicians, all of whom would eventually walk free, were white. It’s important to note that people of color, facing systematic discrimination, were often driven to find income in alternative ways. These alternative ways were, in some cases, illegal. This could have influenced Cantrell’s decision to enter the profession of grave robbing. However, there were gangs of white ghouls in the city working right alongside Cantrell’s gang – grave robbing was a lucrative business if you could get past your moral qualms.
So, the influence of race on Cantrell choosing this line of work isn’t clear. What is clear, however, is that his associates, and not the white physicians, were prosecuted for their crimes. It’s also clear that newspapers took every chance they could to point out the race of the accused. In the end, race can’t not have played a role in the trial, but it’s difficult to tell through reports – all written for white newspapers – how extensive that role was.
On April 26, 1903, Rufus Cantrell, the King of the Ghouls, was found guilty of two charges and sentenced to three to ten years in the Jeffersonville State Reformatory. In the end, Cantrell and four of his associates were convicted and sentenced to between one and ten years each. The twenty other men indicted by the Grand Jury were cleared of all charges due to lack of evidence.
Convictions weren’t the only thing to emerge from this tale, though. The system of public institutions delivering the unclaimed bodies of the deceased directly to medical schools was clearly not working as desired. As a result of this and other similar trials, the Indiana General Assembly passed the Anatomical Education Act in 1903, establishing the State Anatomical Board, which would oversee the distribution of bodies to medical schools. The State Anatomical Board is still in existence today, continuing to oversee the distribution of donated bodies to medical schools. According to anatomist Sanjib Kumar Ghosh, body donation constitutes the sole source of cadavers used in teaching anatomy in the vast majority of the world, including in the United States.
